The Commission has adopted a decision (IP/06/1424 of 18 October 2006) ‘requesting the Court of Justice to impose a lump sum and other penalties on Greece for its failure to implement its 2002 decision in relation to the recovery of a state aid granted by Greece to Olympic Airways between 1998 and 2002’.

Between 1994 and 2000 the Commission took a number of decisions authorising public aid for the restructuring of Olympic Airways. In December 2002, however, the Commission found that further aid had been granted to the airline which was incompatible with the common market, and demanded that €160 million be repaid.

On 6 March 2002, the Commission decided to re-open proceedings in accordance with the requirements of the Treaty establishing the EC with regard to the State aid scheme and with Council Regulation (EC) No 659/1999 on the application of Article 88(ex 93) of the Treaty , for abuse of aids that have already been approved and granted to Olympic Airways, as decided by the Commission in 1994 and 1998 and for new aids that were granted illegally since that time to this company.
