Troisième moyen, tiré de violation des principes de l’interprétation des dispositions statutaires conformément à la Charte européenne des droits fondamentaux et de l’article 31 de la Charte conformément à la décision no 48/03, ainsi que de l’obligation de motivation des arrêts et de la foi due aux actes de procédure, en ce que le TFP, aux points 71 à 74 de son ordonnance, n’a pas tenu compte de l’article 6 de la décision no 48/03 aux fins de l’interprétation de l’article 31, paragraphe 2, de la Charte, n’a pas répondu à suffisance de droit à l’argumentation que le requérant avait tirée de ces dispositions, et a méconnu l’objet et la cause de son recours.
Third plea in law, alleging (i) infringement of the principles that the provisions of the Staff Regulations are to be interpreted in accordance with the European Charter of Fundamental Rights and that Article 31 of the Charter is to be interpreted in accordance with Decision No 48/03; and (ii) infringement of the obligation to state the reasons on which judgments are based and the requirement that pleadings are to be construed in accordance with their actual terms, in that the CST, in paragraphs 71 to 74 of its order, did not have regard to Article 6 of Decision No 48/03 for the purposes of interpreting Article 31(2) of the Charter, failed to respond to the requisite legal standard to the appellant’s arguments based on those provisions, and misinterpreted the subject matter and cause of his action.

Welcomes new instruments such as the Joint European Resources for Micro to Medium Enterprises (JEREMIE) and Joint European Support for Sustainable Investment in City Areas (JESSICA) initiatives; nevertheless points to the fact that these instruments came late to be fully utilised and that awareness of the possibilities they offer at local and regional level is still very low; notes the pressing need for such instruments to be publicised and applied as widely as possible in the Member States, and applied in accordance with the actual situation in those States, with account being taken of the real needs of the potential beneficiaries and their capacity in practical terms to make use of these instruments;
