Is the decision of the Governing Council of the European Central Bank of 6 September 2012 on Technical features of Outright Monetary Transactions incompatible with Article 119 and Article 127(1) and (2) of the Treaty on the Functioning of the European Union and with Articles 17 to 24 of the Protocol on the Statute of the European System of Central Banks and of the European Central Bank because it exceeds the monetary policy mandate of the European Central Bank laid down in the abovementioned provisions and encroaches upon the competence of the Member States?

1. Les États membres exigent des entités assujetties qu'elles s'abstiennent d'exécuter toute transaction dont elles savent ou soupçonnent qu'elle est liée au produit d'une activité criminelle ou au financement du terrorisme, jusqu'à ce qu'elles aient mené à bien les actions nécessaires conformément à l'article 33, paragraphe 1, premier alinéa, point a), et qu'elles se soient conformées à toute autre instruction particulière émanant de la CRF ou des autorités compétentes conformément au droit de l'État membre concerné.

Member States shall require obliged entities to refrain from carrying out transactions which they know or suspect to be related to proceeds of criminal activity or to terrorist financing until they have completed the necessary action in accordance with point (a) of the first subparagraph of Article 33(1) and have complied with any further specific instructions from the FIU or the competent authorities in accordance with the law of the relevant Member State.

Finally, assuming that it could be established, based on a valid comparative analysis, that the ‘prices’ involved in the various transactions that are the subject of this assessment are equivalent to or higher than the ‘market prices’ established through a comparative sample of transactions, the Commission would, for all that, not be able to conclude from this that these transactions comply with MEO test if it emerges that, when they were set, the airport operator had expected them to generate incremental costs higher than the incremental revenues.

4. Les États membres exigent des entreprises d'investissement, dans les cas où leur client a choisi de recevoir les informations sur les transactions exécutées transaction par transaction, qu'elles fournissent sans délai à celui-ci, dès l'exécution d'une transaction par le gestionnaire du portefeuille, les informations essentielles concernant cette transaction sur un support durable.
4. Member States shall require investment firms, in cases where the client elects to receive information about executed transactions on a transaction-by-transaction basis, to provide promptly to the client, on the execution of a transaction by the portfolio manager, the essential information concerning that transaction in a durable medium.
