I. whereas the European Commission against Racism and Intolerance (ECRI), in its 2011 report on Spain, expresses its concern about the Constitutional Court’s 2007 decision declaring the criminalisation of Holocaust denial to be unconstitutional; whereas the judgment states that the simple, neutral denial of some facts without any intention to justify or incite violence, hatred or discrimination has no criminal relevance; whereas 4 of the 12 judges voted against the ruling; whereas ECRI has been informed that the local leader of the Popular Party has been promoting hate speech in Badalona, a city near Barcelona, for several years, accusing Romanian and Roma immigrants of being the cause of crime in the city; whereas civil society organisations have expressed concern about the ‘invisibility’ of racism and racial discrimination in Spain, as well as passivity and a lack of will to acknowledge and deal with the problem at lower levels of government; whereas the fact that there is no data available on racism or racial discrimination contributes to the impression that racism does not exist; whereas the hate crimes and discrimination service of the Barcelona prosecution office was set up in October 2009 following two highly publicised trials of owners of Barcelona bookstores who were selling publications justifying and promoting genocide; whereas, according to the authorities, there are no plans at present to reproduce this service in other Spanish cities and it is too early to evaluate its effectiveness;

Ce projet a fait l’objet de discussions approfondies entre les autorités espagnoles et les services de la Commission à la suite desquelles, en juillet 2000, l’Espagne a présenté un nouveau projet similaire (2000.ES.16.C.PE.035) qui demande le cofinancement du Fonds de cohésion dans la programmation actuelle 2000-2006 ; ce nouveau projet se limite à l’approvisionnement de Saragosse et 22 municipalités se trouvant essentiellement sur le corridor de l’Èbre; ce projet n’inclut pas la connexion initialement prévue entre Yesa et La Loteta par Bardenas et Sora, et n’aura donc aucune incidence sur le Chemin de Saint Jacques à son passage par le Haut Aragon.
The project was discussed in depth between the Spanish authorities and the Commission after which in July 2000, Spain submitted a new project of a similar nature (2000.ES.16.C.PE.035), seeking financing from the Cohesion Fund for the 2000-2006 programming period. This project is limited to Zaragoza and its 22 municipalities, most of which are situated in the Ebre Valley. It does not include the connection between Yesa and Loteta via Badenas and Sora, which was initially envisaged and will therefore have no impact on the Upper Aragon section of the Camino de Santiago.
