1. Lorsqu’une question relative à la validité ou à l’interprétation du présent accord est soulevée dans une affaire en instance devant une juridiction ou un tribunal danois, cette juridiction ou ce tribunal demande à la Cour de justice de se prononcer chaque fois que, dans les mêmes circonstances, une juridiction ou un tribunal d’un autre État membre de l’Union européenne serait tenu de le faire au regard du «règlement Dublin II», du «règlement Eurodac» et de leurs mesures d’application visées à l’article 2, paragraphes 1 et 2.
1. Where a question on the validity or interpretation of this Agreement is raised in a case pending before a Danish court or tribunal, that court or tribunal shall request the Court of Justice to give a ruling thereon whenever under the same circumstances a court or tribunal of another Member State of the European Union would be required to do so in respect of the Dublin II Regulation and the Eurodac Regulation and their implementing measures referred to in Article 2(1) and 2(2).

La Convention exclut de son champ d'application les clauses d'arbitrage - qui, en cas de litige, prévoient la désignation d'un arbitre ou d'un tribunal arbitral plutôt que d'une juridiction étatique - et les clauses d'élection de for - c'est-à-dire des clauses désignant le tribunal étatique compétent en cas de litige, également appelées "clauses attributives de juridiction".
Arbitration clauses - which provide for the designation of an arbitrator or an arbitration board rather than a court in the event of a dispute - and choice of forum clauses - i.e. clauses designating the court having jurisdiction in the event of a dispute - are excluded from the scope of the Convention.

CONSIDÉRANT que la Cour de justice des Communautés européennes devrait être compétente dans les mêmes conditions pour statuer sur les questions préjudicielles relatives à la validité et à l’interprétation du présent accord soulevées par une juridiction ou un tribunal danois, et que les juridictions et tribunaux danois devraient donc procéder à des renvois préjudiciels dans les mêmes conditions que les juridictions et tribunaux d’autres États membres s’agissant de l’interprétation des règlements et de leurs mesures d’application,
CONSIDERING that the Court of Justice of the European Communities should have jurisdiction under the same conditions to give preliminary rulings on questions concerning the validity and interpretation of this Agreement which are raised by a Danish court or tribunal, and that Danish courts and tribunals should therefore request preliminary rulings under the same conditions as courts and tribunals of other Member States in respect of the interpretation of the Regulations and their implementing measures.

En effet, dès lors que, dans la présente affaire, d’une part le fait générateur de responsabilité allégué est intervenu dans l’exercice des fonctions juridictionnelles d’une formation de jugement et que, d’autre part, la formation de jugement appelée à connaître de l’affaire: i) relève de la même juridiction (le Tribunal) que la formation de jugement à laquelle le fait générateur de responsabilité est reproché et ii) fait partie intégrante de la partie défenderesse dans cette affaire (la CJUE), à laquelle ses juges sont professionnellement rattachés, les exigences précitées sont compromises, et ce d’autant plus si, ainsi que l’a jugé le Tribunal, une indemnisation comme celle qui est demandée devait être imputée sur la partie du budget relative à la CJUE.
In view of the fact that, in the present case, first, the matter allegedly giving rise to liability came about in the exercise of judicial functions by a formation of a judicial body and, secondly, the formation that will have to take cognisance of the case (i) belongs to the same judicial body (the General Court) as the formation of the judicial body being held responsible for the matter giving rise to liability and (ii) is an integral part of the defendant party in this case (the CJEU), with which the judges of that formation are professionally affiliated, the abovementioned requirements are compromised, a fortiori where, as the General Court has held, damages such as those here being claimed must come from that part of the budget which relates to the CJEU.

implement fully the judgments of the Constitutional Tribunal of 3 and 9 December 2015. These require that the three judges that were lawfully nominated in October 2015 by the previous legislature can take up their function of judge in the Constitutional Tribunal, and that the three judges nominated by the new legislature without a valid legal basis do not take up the post of judge without being validly elected; publish and implement fully the judgment of 9 March 2016 of the Constitutional Tribunal, as well as all subsequent judgments and ensure that the publication of future judgments is automatic and does not depend on any decision of the executive or legislative powers; ensure that any reform of the Law on the Constitutional Tribunal respects the judgments of the Constitutional Tribunal, including the judgments of 3 and 9 December 2015 and the judgment of 9 March 2016, and takes the Opinion of the Venice Commission fully into account; ensure that the effectiveness of the Constitutional Tribunal as a guarantor of the Constitution is not undermined by requirements, whether separately or through their combined effect; ensure that the Constitutional Tribunal can review the compatibility of the new law adopted on 22 July 2016 on the Constitutional Tribunal before its entry into force and publish and implement fully the judgment of the Tribunal in that respect; refrain from actions and public statements which could undermine the legitimacy and efficiency of the Constitutional Tribunal.

Bien que la possibilité ait été envisagée, ainsi que les synergies potentiellement importantes que pourrait générer un tel mécanisme, dans lequel le Tribunal de première instance serait amené à statuer sur des questions de fond parallèles soit en tant qu'instance d'appel pour les litiges en matière de brevets communautaires, soit en tant que juridiction compétente pour connaître des questions préjudicielles soumises par les juridictions nationales, il a néanmoins été décidé de laisser, pour l'instant, cette compétence à la Cour de justice.
While this question has been considered and held to yield important potential synergies with a view to the Court of First Instance deciding on parallel material issues either as an appeal instance in Community patent litigation or at the request of national courts for a preliminary ruling, it was felt that for the time being this competence should remain with the Court of Justice.
