K. considérant que le gouvernement colombien, son assemblée législative et le peuple colombien sont souverains pour fixer les paramètres de cette juridiction spéciale pour la paix et que cette juridiction comportera des chambres et un tribunal pour la paix, dont la fonction première sera de mettre un terme à l'impunité, de parvenir à la vérité ainsi que de juger et de sanctionner les auteurs des crimes commis pendant le conflit, notamment les crimes les plus graves et les plus représentatifs, afin qu'ils ne se reproduisent plus et que les victimes obtiennent réparation;
K. whereas the Government of Colombia, its legislative chamber and the Colombian people are sovereign in establishing the parameters of this Special Jurisdiction for Peace and that said Jurisdiction will have law courts and a Peace Tribunal, whose vital task it will be to put an end to impunity, uncover the truth and judge and punish the perpetrators of crimes committed during the conflict, in particular the most serious and representative ones, ensuring there is no repetition and contributing in addition to reparations for victims;

C. whereas the latter partial agreement’s paragraph on victims is of the utmost importance, and provides for the establishment of a Special Jurisdiction for Peace and a court to bring all those responsible for the conflict, including military and paramilitary personnel, guerrillas and civilians, to justice, and is probably the biggest step forward made in three years of negotiation;

The Minister may, if in his opinion it is advisable or necessary for the proper administration of this Act, authorize any district, county or other judge to exercise any or all of the powers and jurisdiction of the court or of a judge or registrar thereof, subject to any limitation or condition, and any judge so authorized shall be deemed a judge or registrar, as the case may be, of the court having jurisdiction in bankruptcy, and references to the court, to the judge of the court or to the registrar apply to that district, county or other judge according to the terms of his authority.

(a) where, in a Will of a veteran, an executor has been named and such nominee has been appointed executor by a court of competent jurisdiction, or where an administrator or an administrator with Will annexed has been appointed by a court of competent jurisdiction, or where the executor named in an unprobated Will has proved to the satisfaction of the Estates Officer that such Will is the last Will of the deceased and that he has assumed the executorship or become an executor de son tort or is willing to accept the executorship of such Will, the Estates Officer may cause to be delivered over to such executor or administrator, for distribution, the net assets of the service estate in his possession;

190 (1) Any document made or used in the course of any bankruptcy proceedings or other proceedings had under this Act shall, if it appears to be sealed with the seal of any court having jurisdiction in bankruptcy, purports to be signed by any judge thereof or is certified as a true copy by any registrar thereof, be admissible in evidence in all legal proceedings.

Il me semble qu'il y a trois possibilités pour traduire ces personnes devant les tribunaux: nous pouvons laisser les Irakuiens traiter comme ils l'entendent ces personnes, après la libération, un peu comme cela a été fait pour Ceausescu, rendre une justice rapide et brutale, nous pouvons autoriser les puissances occupantes à utiliser le précédent de Nuremberg et elles pourraient alors créer en Irak leur propre juridiction, ou enfin les Nations Unies, par l'intermédiaire du Conseil de sécurité, pourrait adopter une résolution semblable à celle qui concernait le Rwanda et la Yougoslavie et créer un tribunal pénal international spécial.
It seems to me that there are three possibilities in terms of bringing these people to justice: we leave it to the Iraqi people themselves, post-liberation, to do what they will with these people, perhaps in a Ceausescu manner of swift and brutal justice; or we allow the occupying powers to use the Nuremberg precedent and therefore jurisdiction in Iraq to establish their own court of justice; or the United Nations, through the Security Council, passes a resolution similar to those affecting Rwanda and Yugoslavia for the creation of a special international criminal tribunal.
