Declares that by failing to transpose Council Directive 79/409/EEC of 2 April 1979, on the conservation of wild birds, into Italian law in a manner which is wholly in compliance with that directive, and by failing to transpose Article 9 of that directive in a manner which ensures that the derogations adopted by the competent Italian authorities comply with the conditions and requirements referred to in that article, the Italian Republic has failed to fulfil its obligations under Articles 2 to 7, 9 to 11, 13 and 18 of the directive;

Cet accord prévoit, à son article 8, paragraphe 2, que les décisions exécutoires relatives à l'annulation d'un mariage prononcées par des tribunaux ecclésiastiques produiront leurs effets en Italie par le biais d'une décision de la «Corte d'appello» compétente si les conditions suivantes sont réunies: a) le juge ecclésiastique était compétent pour connaître du cas s'agissant d'un mariage célébré conformément aux conditions établies dans ce même article; b) au cours de la procédure devant le tribunal ecclésiastique les droits des parties de comparaître et de se défendre, ont été respectés, conformément aux principes fondamentaux de l'ordre juridique italien et c) les autres conditions requises par la législation italienne pour donner effet aux décisions étrangères sont réunies.
Article 8(2) provides that marriage annulment judgments by the ecclesiastical courts which are enforceable will produce effects in Italy by decision of the 'Corte d'appello` having jurisdiction, provided that: (a) the ecclesiastical court had jurisdiction over the case in that it was a marriage celebrated in accordance with the requirements laid down by that Article; (b) the procedure before the ecclesiastical courts afforded the parties the right to appear and to be defended, in accordance with the fundamental principles of the Italian legal system; (c) the conditions required by Italian legislation for declaring foreign judgments effective have been met.

A l'issue de ses délibérations, le Conseil a adopté les conclusions suivantes : "Le CONSEIL, - RAPPELLE que, dans sa résolution du 7 février 1994, il avait invité la Commission à proposer avant le 1er juillet 1994 les mesures nécessaires à la réalisation des objectifs identifiés pour mettre en oeuvre rapidement une politique communautaire des services postaux, et notamment des mesures relatives au service universel, aux services réservables et à la normalisation; - PREND NOTE de ce que la Commission a adopté en ce sens, en date du 26 juillet 1995, une approche globale comportant le projet de communication précité ainsi qu'une proposition de directive, basée sur l'article 100 A, prévoyant un cadre harmonisé pour le secteur postal ; - SOULIGNE que les travaux techniques ont été engagés sans délai par les instances compétentes du Conseil et que ce dernier a procédé ce jour à un premier débat d'orientation sur la proposition de directive et à un débat sur le projet de communication ; - CONVIENT de poursuivre activement ses travaux sur la proposition de directive afin de parvenir rapidement à un accord sur une position commune sous les auspices de la Présidence italienne ; - NOTE que la communication envisagée par la Commission ne revêt pas en elle-même un caractère contraignant mais constitue un document par lequel celle-ci fait connaître les lignes directrices qu'elle entend suivre dans l'application au secteur de la poste des règles de concurrence du traité; - DEMANDE à cet égard à la Commission, dans la mesure où elle entendrait donner suite à son projet de communication, de tenir le plus grand compte des observations du Conseil en particulier de la nécessité de veiller, dans un souci de transparence et de sécurité juridique, - à ce que les définitions et les concepts utilisés respectivement dans la communication et dans la proposition de directive ou dans d'autres dispositions communautaires pertinentes soient cohérents ; - à ce que la publication de la commun ...
At the close of its discussions the Council adopted the following conclusions: "THE COUNCIL - REITERATES that in its Resolution of 7 February 1994 it invited the Commission to propose, before 1 July 1994, the measures necessary for the realization of the objectives identified, with a view to implementing without delay a Community policy on postal services, and in particular measures relating to universal service, services which can be reserved, and standardization; - NOTES that on 26 July 1995 the Commission accordingly adopted an overall approach consisting of the abovementioned draft Notice and a proposal for a Directive based on Article 100a, providing for a harmonized framework for the postal sector; - EMPHASIZES that the relevant Council bodies began the technical discussions without delay and that today the Council had an initial policy debate on the proposal for a Directive and a debate on the draft Notice; - AGREES to continue active discussion of the proposal for a Directive in order to arrive at an agreed common position under the auspices of the Italian Presidency; - OBSERVES that the Notice envisaged by the Commission is not in itself binding but is a document in which it announces the guidelines it intends to follow in applying the Treaty's competition rules to the postal sector; - REQUESTS the Commission, in any follow-up to its draft Notice, to take the utmost account of the Council's comments, especially on the need to ensure, for the sake of transparency and legal certainty, that: - the definitions and concepts used in the Notice, in the proposal for a Directive or in other relevant Community provisions are consistent with one another; - the notice is published in the Official Journal at the same time as the Directive and in any case before the end of 1996; - EMPHASIZES that these conclusions are without prejudice to the positions of the Member States on the form and content of the Commission Notice".
