Member States shall ensure that trade unions and other third parties, such as associations, organisations and other legal entities which have, in accordance with the criteria laid down under national law, a legitimate interest in ensuring that this Directive and Directive 96/71/EC are complied with, may engage, on behalf or in support of the posted workers or their employer, and with their approval, in any judicial or administrative proceedings with the objective of implementing this Directive and Directive 96/71/EC and/or enforcing the obligations under this Directive and Directive 96/71/EC.

Member States shall ensure that associations, organisations, including the social partners, or other legal entities, which have, in accordance with the criteria laid down in their national law, practice or collective agreements, a legitimate interest in ensuring that this Directive is complied with, may engage, either on behalf of or in support of, Union workers and members of their family, with their approval, in any judicial and/or administrative procedure provided for the enforcement of the rights referred to in Article 1.

Where results are capable or may reasonably be expected to be capable of commercial or industrial exploitation, the participant owning these results shall examine the possibility for protection and, if possible and justified given the circumstances, shall adequately protect them for an appropriate period of time and with an appropriate territorial coverage, having due regard to legitimate interests of all involved participants, particularly the commercial interests.

Parmi les moyens mentionnés au paragraphe 4 figurent des dispositions permettant aux organisations officiellement reconnues comme représentant les entreprises, ou ayant un intérêt légitime à les représenter, de saisir, conformément aux législations nationales applicables, les juridictions ou les instances administratives compétentes, au motif que les clauses contractuelles ou les pratiques sont manifestement abusives, au sens du paragraphe 1, de sorte qu’elles puissent recourir à des moyens appropriés et efficaces pour mettre fin à leur utilisation.
5. The means referred to in paragraph 4 shall include provisions whereby organisations officially recognised as representing undertakings, or organisations with a legitimate interest in representing undertakings may take action according to the applicable national law before the courts or before competent administrative bodies on the grounds that contractual terms or practices are grossly unfair within the meaning of paragraph 1, so that they can apply appropriate and effective means to prevent their continued use.

The agreement that has been reached does not fully reconcile the legitimate interests of all the parties, so it is important to undertake certain actions aimed at better implementation of the agreements at various levels, especially through an assessment of the impact on developing countries that supply bananas, and on Europe’s outermost regions.
