À la lumière de l’expérience acquise par la Commission et les États membres, le système institué par le règlement (CEE) no 595/91 du Conseil du 4 mars 1991, concernant les irrégularités et la récupération des sommes indûment versées dans le cadre du financement de la politique agricole commune ainsi que l’organisation d’un système d’information dans ce domaine, et abrogeant le règlement (CEE) no 283/72 (2) devrait être ajusté de façon à harmoniser son application dans les États membres, à intensifier la lutte contre les irrégularités, à renforcer l’efficacité du système de communication des irrégularités, à tenir compte du fait que les cas individuels d’irrégularité seront désormais réglés conformément aux articles 32 et 33 du règlement (CE) no 1290/2005, et à couvrir le FEAGA et le Feader à partir du 1er janvier 2007.
In the light of the experience gained by the Commission and by the Member States, the system provided for in Council Regulation (EEC) No 595/91 of 4 March 1991 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the common agricultural policy and the organisation of an information system in this field and repealing Regulation (EEC) No 283/72 (2) should be adjusted in order to harmonize its application in the Member States, to intensify the campaign against irregularities, to enhance the effectiveness of the system of reporting irregularities, to take into account that individual irregularity cases will henceforth be cleared according to the provisions of Articles 32 and 33 of Regulation (EC) No 1290/2005 and to cover both the EAGF and the EAFRD from 1 January 2007 onwards.

En vue d’établir la nature des pratiques frauduleuses et les effets financiers des irrégularités ainsi que de suivre la récupération des sommes indûment versées, il est nécessaire de prévoir la communication des cas d’irrégularités à la Commission selon une fréquence au moins trimestrielle; cette communication devrait être complétée par des indications relatives au déroulement des procédures judiciaires ou administratives.
With a view to ascertaining the nature of fraudulent practices and the financial effects of irregularities and to monitoring the recovery of sums wrongly paid, provision should be made for irregularities to be communicated to the Commission at least every quarter; such communication should be supplemented by information on the progress of judicial or administrative procedures.
