Following that tendering procedure, the Systran group took the view that the Commission had unlawfully disclosed its know-how to a third party and carried out an act of counterfeiting when Gosselies carried out unauthorised developments of the EC-Systran Unix version.

Considérant que, à la suite de l’attribution de l’appel d’offres, la Commission avait divulgué illégalement son savoir-faire à un tiers et qu’elle avait réalisé un acte de contrefaçon à l’occasion de la réalisation par l’attributaire du marché de développements non autorisés de la version EC-Systran Unix, le groupe Systran a introduit une action en réparation contre la Commission devant le Tribunal.
Taking the view that, after the award of the tender contract, the Commission had unlawfully disclosed its know-how to a third party and that the Commission was infringing its copyright when unauthorised development of the EC-Systran Unix version was carried out by the successful contractor, the Systran group brought an action for damages against the Commission before the General Court.

La Commission a ainsi considéré que le groupe Systran n’était pas en droit de s’opposer aux travaux réalisés par la société qui avait remporté l’appel d’offres.
The Commission therefore considered that the Systran group had no right to object to the work carried out by the company which had been successful in the call for tenders.
