Pour déterminer le solde ou la valeur agrégé des Comptes financiers détenus par une Entité, une Institution financière déclarante doit tenir compte de tous les Comptes financiers détenus auprès d'elle ou auprès d'une entité liée, mais uniquement dans la mesure où ses systèmes informatiques établissent un lien entre ces comptes grâce à une donnée telle que le numéro de client ou le NIF, et permettent ainsi d'effectuer l'agrégation des soldes ou des valeurs des comptes.

The Commission understands that the Honorouble Member is referring to international conventions the ratification of which is pending for reasons relating to the dispute between the United Kingdom and Spain over Gibraltar and does not refer to the accession to the Hague Convention on the Law Applicable to Certain Rights in Respect of Securities held with an Intermediary where the Council is substantially divided as to the desirability of a ratification, since the Parliament itself, in a resolution adopted on 14 December 2006, urged the Council not to sign this Convention until a comprehensive impact study had established that such accession would not create distortions in the internal market in financial services.

Believes that inconsistencies between national laws on transferring financial instruments are one of the main reasons why costs are higher for cross-border than for domestic transactions; supports ongoing attempts to harmonise these laws but acknowledges that this project could take many years to complete; welcomes the setting-up by the Commission of the Legal Certainty Group; urges the Commission to step up the work of that group as a priority instrument for promoting convergence at European level; calls on the Commission to act upon the results of this work and to cooperate closely with third countries and groups such as Unidroit and the Hague Convention of 13 December 2002 on the law applicable to certain rights in respect of securities held with an intermediary and calls for the European Parliament and the Member States to be associated in due course with defining the European negotiating position within this framework;
