La directive fusionne les trois directives du «premier paquet ferroviaire» concernant le développement des chemins de fer européens, les licences des entreprises de transport et la gestion des infrastructures ferroviaires (Directives 2001/12/CE2001/13/CE et 2001/14/CE) respectivement.
The directive merges the 3 directives from the ‘first rail package’ concerning the development of Europe's railways, the licensing of railway undertakings and the management of railway infrastructure (Directives 2001/12/EC2001/13/EC and 2001/14/EC) respectively.

La Commission reproche, premièrement, à la France de ne pas avoir prévu la séparation des entités assurant l'exploitation des services ferroviaires (en l’occurrence, la Société nationale des chemins de fer français, « SNCF ») de celles chargées de gérer l'infrastructure (Réseau ferré de France, « RFF »), notamment en ce qui concerne l’exercice des fonctions considérées comme essentielles, dont l’allocation des sillons ferroviaires (directive 91/440/CEE) . Or, la SNCF, à travers la Direction des Circulations Ferroviaires (« DCF »), qui à l’époque n’était pas indépendante de la SNCF, demeurerait chargée de l'attribution des sillons.
The Commission alleged, first, that France did not make provision for the separation of SNCF, the entity providing rail transport services, from RFF, the organisation responsible for managing the infrastructure in particular as regards the performance of functions deemed essential, which included the allocation of train paths (Directive 91/440/EEC) . It claimed that the SNCF, through the Direction des circulations ferroviaires (‘DCF’), which at the time was not independent of SNCF, remained in charge of the allocation of train paths.
