À la suite de l'information des parties, TK Corporation a expliqué que la Commission aurait dû baser son analyse du dumping sur les ventes à l'exportation réalisées par l'entreprise à destination de l'Union européenne et ce, pour les raisons suivantes: i) ses ventes à l'exportation vers l'Union européenne au cours de la PER ont été significatives et donc représentatives, dans la mesure où elles ont fait intervenir pas moins de «26 factures pour 282 transactions individuelles, malgré les droits existants»; ii) faute de clarté en ce qui concerne le paiement de droits antidumping, certaines des ventes (destinées à un projet off-shore) ne devraient pas faire l'objet d'un droit antidumping, sachant que d'autres ventes intervenues durant la PER n'ont pas toujours été soumises au paiement de tels droits par les importateurs, en raison d'une mauvaise classification des produits concernés, si bien que les importateurs n'ont pas réalisé qu'ils devaient s'acquitter de droits antidumping.
Following disclosure, TK Corporation submitted that the Commission should have based its dumping analysis on the Union export sales of the company, for the following reasons: (i) its export sales to the Union during the RIP were significant and therefore representative, as they consisted of ‘no less than 26 invoices with 282 individual transactions, despite duties being in place’; (ii) in the absence of clarity as concerns anti-dumping duty payment, some of the sales (destined for an offshore project) would not be subject to the anti-dumping duty, whereas for other sales that occurred during the RIP, anti-dumping duties were not always paid by importers as a result of misclassification of those products due to which the importers did not realise that anti-dumping duties were payable.

L’article 3, paragraphe 1, du règlement (CE) no 661/2008 du Conseil, du 8 juillet 2008, instituant un droit antidumping définitif sur les importations de nitrate d’ammonium originaire de Russie à la suite d’un réexamen au titre de l’expiration des mesures conformément à l’article 11, paragraphe 2, et d’un réexamen intermédiaire partiel conformément à l’article 11, paragraphe 3, du règlement (CE) no 384/96, doit être interprété en ce sens qu’une société établie dans un État membre qui a acheté du nitrate d’ammonium d’origine russe, par l’intermédiaire d’une autre société également établie dans un État membre, en vue de son importation dans l’Union européenne, ne peut pas être considérée comme le premier client indépendant dans l’Union européenne, au sens de cette disposition, et ne peut donc pas bénéficier de l’exonération du droit antidumping définitif institué par le règlement no 661/2008 pour ce nitrate d’ammonium.
Article 3(1) of Regulation (EC) No 661/2008 of 8 July 2008, imposing a definitive anti-dumping duty on imports of ammonium nitrate originating in Russia following an expiry review pursuant to Article 11(2) and a partial interim review pursuant to Article 11(3) of Regulation (EC) No 384/96, must be interpreted as meaning that a company established in a Member State, which purchased ammonium nitrate originating in Russia, through another company also established in a Member State, with a view to importing it into the Union, may not be considered to be the first independent customer in the Union, within the meaning of that provision, and may not therefore be eligible for the exemption from definitive anti-dumping duty laid down by that regulation in respect of the ammonium nitrate.

So far as justice and internal affairs are concerned, the most important changes from the budgetary point of view are therefore the enlargement-related increase in appropriations for programmes (EUR 16 million) and the increase in appropriations for control of the external frontiers, which has been a major European Union priority since the Seville and Thessaloniki summits.

Subsequent to the adoption of Leonardo da Vinci II in April 1999, a number of policy initiatives have been launched with a major impact on vocational training policy and consequently on Leonardo da Vinci II : the Lisbon strategy of March 2000, which accords an important role to education and training for the achievement of its goals [4]; the communication of the Commission on 'Making a European Area of Lifelong Learning a Reality' [5], setting a new paradigm for education and training; the report of the Education Council and the European Commission on the common objectives of education and training systems [6], and the subsequent detailed work programme [7]; the Council resolution of November 2002 on enhanced European co-operation in Vocational Education and Training (VET) [8] extended by the subsequent Copenhagen declaration that was adopted by 31 Ministers, the Commission and the social partners at European level; the Action Plan for the promotion of language learning and linguistic diversity [9], adopted by the Commission in July 2003 and based on the experience of the European Year of languages.

(19) Étant donné que les objectifs de l'action envisagée, qui concerne la contribution de la coopération européenne à une éducation de qualité, ne peuvent pas être réalisés de manière suffisante par les États membres par suite notamment du besoin de promouvoir les partenariats multilatéraux, la mobilité multilatérale et les échanges d'informations entre la Communauté et les pays tiers, et qu'ils peuvent donc, en raison de la dimension transnationale des actions et mesures communautaires, être mieux réalisés au niveau communautaire, la Communauté peut adopter des mesures conformément au principe de subsidiarité consacré par l'article 5 du traité.
(19) Since the objectives of the proposed action concerning the contribution of European cooperation to quality education cannot be sufficiently achieved by the Member States, inter alia, because of the need for multilateral partnerships and multilateral mobility and exchanges of information between the Community and third countries and can therefore be better achieved at Community level owing to the transnational dimension of Community actions and measures, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
