Beniamino Donnici a contesté, par un recours devant le tribunal administratif régional du Latium en date du 30 mai 2006 (inscription au greffe n° 5258/2006), la décision du Bureau électoral national, en déduisant son caractère illégitime de l'annulation des articles 20, 21, 22 et 41 de la loi n° 18 du 24 janvier 1979, ainsi que des principes généraux régissant les élections, et de la proclamation comme élu d'Achille Occhetto, qui avait renoncé dès le 7 juillet 2004 à l'élection et ne figurait donc plus sur la liste des candidats élus et des éventuels remplaçants, transmise au Parlement européen le 12 novembre 2004.

By means of an appeal submitted on 30 May 2006 to the Lazio Regional Administrative Tribunal (RG No 5258/2006), Mr Beniamino Donnici challenged the action taken by the National Electoral Office on the grounds that it was illegitimate, since it infringed Articles 20, 21, 22 and 41 of Law No 18 of 24 January 1979 and also the general principles relating to elections, and since Mr Achille Occhetto had been declared elected, even though he had withdrawn on 7 July 2004, which meant that he did not appear on the list of the elected candidates and the possible substitutes which had been forwarded to the European Parliament on 12 November 2004.

Does the Council recall the supplementary question asked by Mr David Martins (PSE) following Oral Question H‑0577/04 asked by the GUE/NGL Group at the European Parliament sitting of 23 February 2005, in which Mr Martins pointed out that Mr Vanunu had been taken from European soil illegally in 1986 and in which he asked if the Council would encourage the Israeli Government to stop their persecution of this individual, allow him to leave Israel and, if he so desired, to live in the European Union, to which Minister Schmit, on behalf of the Luxembourg Presidency replied, ‘yes, I will’?
