Le présent article s'applique à la fourniture de services de transport aérien au départ d'un aéroport situé sur le territoire d'un État membre auquel le traité s'applique, au départ d'un aéroport situé dans un pays tiers à destination d'un aéroport situé sur le territoire d'un État membre si le contractant du transport aérien est communautaire, ou d'un aéroport situé dans un pays tiers à destination d'un autre pays tiers si le vol fait partie d'un voyage qui a commencé dans la Communauté, pour autant que le contractant du transport aérien ait un établissement dans la Communauté, que le contrat ait été conclu dans la Communauté, ou que le passager ait sa résidence habituelle dans la Communauté.
This article shall apply to the provision of air transport services when the flight departs from an airport in the territory of a Member State to which the Treaty applies, from an airport located in a third country, bound for an airport on the territory of a Member State if a Community air carriage contractor is involved, or from an airport located in a third country, bound for another third country if the flight is part of a journey which started in the Community, provided the air carriage contractor has an establishment in the Community, the contract was concluded within the Community or the passenger's normal place of residence is within the Community.
