La Commission avait demandé à la Cour d’annuler la décision-cadre 2003/80/JAI du Conseil du 27 janvier 2003 relative à la protection de l’environnement par le droit pénal[1], qui obligeait les Etats membres à prévoir des sanctions pénales pour sanctionner les infractions au droit de l’environnement définies dans cette décision cadre, au motif que la compétence pour imposer une telle obligation aux Etats membres relevait d’un instrument communautaire dont la Commission avait d’ailleurs proposé l’adoption[2].

The Commission had asked the Court to annul Council Framework Decision 2003/80/JHA of 27 January 2003 on the protection of the environment through criminal law[1], which required the Member States to provide for criminal sanctions in the case of the offences against environmental law set out in the Framework Decision, on the grounds that the power to impose such an obligation on the Member States is a matter for a Community instrument and the Commission had in fact proposed the adoption of such an instrument[2].

The Commission expressed a general reservation about the framework decision, pointing out that environmental protection (including, naturally, protection of waters) was covered by a large number of Community texts, most of which made provision for administrative sanctions; it therefore considered that the issue should be dealt with using a Community instrument (first pillar) based on Article 175(1) of the EC Treaty, not least in order to establish an acquis communautaire with a view to the forthcoming enlargement.
