A cet égard, si l'achat en commun de droits de retransmission télévisée d'un événement ne constitue pas en soi une restriction de la concurrence contraire aux dispositions du Traité et peut être justifié par les particularités du produit et du marché en cause, il ne reste pas moins, précise le Tribunal ,que l'exercice de ces droits dans un contexte juridique et économique spécifique peut entraîner une telle restriction.
While it is true that the joint purchase of televised transmission rights for an event is not in itself a restriction on competition in breach of the provisions of the Treaty and may be justified by particular characteristics of the product and the market in question, the Court of First Instance points out that the exercise of those rights in a specific legal and economic context may none the less lead to such a restriction.
