(2) An officer or militiaman to whom subsection (1) applies, shall be required to elect whether he shall be granted the pension therein mentioned, and if he so elects his service from the date of his enlistment in the Force while belonging to the said Army Reserve until the date he was struck off the strength of the Canadian Expeditionary Force, shall not be included in the term of service for any other pension or a gratuity under this Act; any gratuity or pension under this Act granted to an officer or militiaman prior to his so electing shall be re-computed as of the date on which the pension mentioned in subsection (1) commenced by excluding from the term of service on which such gratuity or pension was based the service first mentioned in this subsection; if by the exclusion of such service the officer or militiaman has not sufficient service to entitle him to a gratuity or pension, or the gratuity or pension to which he would be entitled on such re-computation is less than the gratuity or pension heretofore granted, there will be recovered from the pension payable to such officer or militiaman, under subsection (1), all payments of gratuity and pension or overpayments thereof which have resulted; but if an officer who has already been granted a pension under this Act elects as aforesaid, and by the exclusion of the service mentioned he becomes ineligible for the grant of such pension, but becomes eligible for the payment of a gratuity under this Act, then such gratuity shall be applied toward the recovery of the payments of pension already made, and any balance of such payments not met by the application of such gratuity shall be recovered from the pension payable to such officer under subsection (1).

(2) a) Lorsque, avant l’entrée en vigueur du présent Accord, un travailleur, autre que le travailleur décrit à l’Article VI, assujetti à la législation d’une Partie et au service d’un employeur ayant sa place d’affaires sur le territoire de ladite Partie, a été détaché par ledit employeur sur le territoire de l’autre Partie pour y travailler, il pourra, dans les trois mois suivant l’entrée en vigueur du présent Accord, décider si c’est la législation de la première ou de la seconde Partie qui doit lui être appliquée relativement à cette relation de travail; s’il décide d’être assujetti à la législation de la première Partie, la législation de ladite Partie lui sera appliquée pendant une période maximale de 24 mois. S’il décide d’être assujetti à la législation de la seconde Partie, la législation de ladite Partie lui sera appliquée. Dans l’un et l’autre cas, son choix sera exécutoire à compter du jour où il en donnera avis à l’autorité compétente appropriée.
(2) (a) Where, prior to the entry into force of this Agreement, a worker other than a worker referred to in Article VI, who is subject to the legislation of one Party and who is employed by an employer having his place of business in the territory of that Party has been sent by that employer to work in the territory of the other Party, he shall after the entry into force of this Agreement be entitled to choose within three months of such entry into force that the legislation of one Party or the other shall apply to him in respect of such employement; and if he chooses to be covered under the legislation of the first Party, then the legislation of that Party shall apply to him for a period of up to 24 months; and if he chooses to be covered under the legislation of the second Party, then the legislation of that Party shall apply to him; and in either case his choice shall take effect from the day on which he gives notice to the appropriate competent authority.

34. Les dispositions du chapitre 61 des Statuts du Canada de 1919, intitulé Loi modifiant la Loi des pensions de la milice, rendu exécutoire le 7 juillet 1919, s’appliquent aux officiers et miliciens qui, par suite de blessures reçues ou d’invalidité soufferte pendant leur activité de service au cours de la guerre entre la Grande-Bretagne et l’Allemagne, laquelle guerre commença le 4 août 1914, ont été mis à la retraite ou licenciés des forces avant ledit 7 juillet 1919; un officier qui, par suite de cette retraite avant une époque à laquelle une pension aurait pu lui être accordée, recevait une gratification et qui, en vertu du présent article, aura droit à une pension sous le régime de la présente loi, est requis de choisir s’il lui sera accordé cette pension, et s’il fait ainsi son choix, il doit rembourser cette gratification de la manière que peut décider le gouverneur en conseil.
34. The provisions of chapter 61 of the Statutes of Canada, 1919, being An Act to amend the Militia Pension Act, which came into force on the 7th day of July 1919, apply to those officers and militiamen who by reason of wounds or disabilities received or suffered while on active service during the war between Great Britain and Germany, which commenced on the 4th day of August 1914, were retired or discharged from the force prior to the said 7th day of July 1919, and an officer who, by reason of such retirement before a period at which a pension might have been granted him, received a gratuity and who will by virtue of this section, become eligible for the grant of a pension under this Act, shall be required to elect whether he shall be granted such pension and if he so elects he shall repay such gratuity in such manner as the Governor in Council may determine.
