La règle dite «des dix mois», prévue à l’article 44, paragraphe 3, du règlement (CE) n° 1782/2003 du Conseil, s’est révélée difficile à mettre en œuvre par les États membres.
The so-called "10-month rule" laid down in Article 44(3) of Council Regulation (EC) No 1782/2003 proved difficult to manage by Member States and has a disproportionate impact on the land market.

1. À compter de la fin de la période de dix-huit mois prévue à l’article 67, paragraphe 5, du règlement d’application, l’institution créditrice peut percevoir des intérêts de retard sur les créances non payées, sauf si l’institution débitrice a versé, dans un délai de six mois à compter de la fin du mois au cours duquel la créance a été introduite, un acompte d’un montant au moins égal à 90 % du total de la créance introduite en vertu de l’article 67, paragraphe 1 ou 2, du règlement d’application.
1. From the end of the 18-month period set out in Article 67(5) of the implementing Regulation, interest can be charged by the creditor institution on outstanding claims, unless the debtor institution has made, within six months of the end of the month during which the claim was introduced, a down payment of at least 90 % of the total claim introduced pursuant to Article 67(1) or (2) of the implementing Regulation.

Absences from the EU country for periods of less than six consecutive months (and not exceeding ten months in total within the five-year period) or for specific reasons provided for by national law (e.g. military service, secondment for work purposes, serious illness, maternity, research or studies) will be regarded as not interrupting the period of residence.

In that event, the time-limit laid down in Article 91(3) of the Staff Regulations would have expired, in principle, three months and ten days from 23 July 2009, that is to say, on 2 November 2009.

If a Contracting Party sends the Secretary-General of the Council a communication as provided for in paragraph 3(b) of this Article, it may, so long as it has not notified the Secretary-General of the Council of its acceptance of the recommended amendment, submit an objection to that amendment within a period of 18 months following the expiry of the six-month period referred to in paragraph 3 of this Article.

2. Sans préjudice du délai de dix ans prévu à l'article 44, troisième alinéa, du statut, la révision est demandée au plus tard dans un délai de trois mois à compter du jour où le demandeur a eu connaissance du fait sur lequel la demande en révision est fondée.
