Deuxième moyen, tiré du fait que le Conseil n’a pas respecté le critère de l’inscription sur la liste, à savoir que la personne a été «identifiée comme étant responsable» de détournement de fonds appartenant à l’État ukrainien ou de violations des droits de l’homme en Ukraine, ou est une personne liée avec qui que ce soit ayant été identifié comme tel. La seule raison donnée pour justifier l’inscription sur la liste du requérant était qu’il fait prétendument l’objet d’une «enquête» en Ukraine pour sa participation à des infractions liées au détournement de fonds publics ukrainiens et à leur transfert illégal hors d’Ukraine.
Second plea in law, alleging that the Council failed to fulfil the criterion for listing, namely that the person has been ‘identified as responsible’ for misappropriation of Ukrainian State funds or human rights violations in Ukraine, or is a person associated with anyone who has been so identified. The only reason given for the listing of the applicant was that he was said to be subject to ‘investigation’ in Ukraine for involvement in crimes in connection with the embezzlement of Ukrainian State funds and their illegal transfer outside Ukraine.

D'autre part, si l'amendement vise simplement à assurer qu'une information soit donnée aux opérateurs économiques dans ce délai de deux mois, il est superflu, étant donné que le deuxième alinéa prévoit déjà que « Si la décision de qualification doit prendre plus de six mois à partir du dépôt de la demande de qualification, l'entité adjudicatrice doit informer le demandeur, dans les deux mois suivant ce dépôt, des raisons justifiant un allongement du délai et de la date à laquelle sa demande sera acceptée ou refusée".
Moreover, if the intention of the amendment is to ensure that economic operators are provided with information by the two-month deadline, it is superfluous, as the second subparagraph already states that "if the decision will take longer than six months from the presentation of an application, the contracting entity shall inform the applicant, within two months of the application, of the reasons justifying the longer period and of the date by which his application will be accepted or refused".
