Member States may issue the special permit for fishing for cod referred to in paragraph 1 only to Community vessels holding in 2005 a special permit for fishing for cod in the Baltic Sea in accordance with point 6.2.1 of Annex III to Council Regulation (EC) No 27/2005 of 22 December 2004 fixing for 2005 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks, applicable in Community waters and, for Community vessels, in waters where catch limitations are required (10).

Sans préjudice de règles spéciales, lorsqu’un navire de pêche communautaire détenant à son bord ou, le cas échéant, déployant un ou plusieurs engins de pêche faisant l’objet d’un régime de gestion de l’effort de pêche ou opérant dans une pêcherie faisant l’objet d’un régime de gestion de l’effort de pêche traverse le même jour deux zones géographiques ou plus relevant de ce régime, l’effort de pêche déployé est imputé sur l’effort de pêche maximal autorisé lié à l’engin de pêche ou à la pêcherie concerné et à la zone géographique dans laquelle il a passé le plus de temps au cours de cette journée.

Without prejudice to special rules, where a fishing vessel carrying on board or, where appropriate, deploying a fishing gear or gears subject to a fishing effort regime or operating in a fishery subject to a fishing effort regime crosses during the same day two or more geographical areas subject to that fishing effort regime, the fishing effort deployed shall be counted against the maximum allowable fishing effort related to such fishing gear or such fishery and to the geographical area in which the largest proportion of time was spent during that day.

However, a Member State may issue a special permit for fishing for cod to a Community vessel, flying the flag of that Member State, not holding a special fishing permit in 2005 if it ensures that at least an equivalent capacity, measured in kilowatts (kW), is prevented from fishing in the Baltic Sea with any gear referred to in paragraph 1.

Equipment listed as "new item" under the heading "item designation" of Annex A.1, and manufactured before the date referred to in Article 3(1), may be placed on the market and on board a Community ship, the certificates of which were issued by or on behalf of a Member State in accordance with international conventions, during the two years following that date if it was manufactured in accordance with procedures for type-approval already in force within the territory of that Member State before the date of the adoption of this Directive.

Enfin, tout comme il est important que les États dont les navires exercent dans les eaux de la NAFO soient parties contractantes, il est important que la Communauté européenne fasse partie des organisations régionales qui se créent dans l’Atlantique sud et partout où la flotte communautaire est déjà en activité.
Lastly, it is extremely important that countries with vessels operating in NAFO waters are Contracting Parties, just as it is important that the European Community is also a Contracting Party to regional organisations being set up in the South Atlantic and beyond the area the Community fleet currently operates in.

(9) considérant que la Communauté a déjà entamé la procédure d'adhésion à cette organisation mais que cette adhésion pourrait être retardée pour des raisons techniques; qu'il est donc nécessaire d'appliquer provisoirement l'accord relatif au programme international pour la conservation des dauphins afin de sauvegarder, pendant la période intérimaire, les intérêts des navires communautaires pêchant dans la région;
(9) Whereas the Community has already started the procedure for accession to that organisation but such accession could be delayed for technical reasons; whereas it is therefore necessary to apply the Agreement on the International Dolphin Conversation Programme provisionally in order to protect the interests of Community vessels fishing in the region during the interim period;
