4. Au plus tard le 1 er janvier 2018, la Commission élabore un rapport, après consultation de l'AEMF et de l'ACER, dans lequel elle évalue l'incidence potentielle sur les prix de l'énergie et le fonctionnement du marché de l'énergie ainsi que la faisabilité et les avantages en termes de réduction des risques systémiques et de contrepartie ainsi que des coûts directs découlant du fait que les contrats dérivés des produits énergétiques C6 soient soumis à l'obligation de compensation établie à l'article 4 du règlement (UE) n° 648/2012 et aux techniques d'atténuation des risques énoncées à l'article 11, paragraphe 3, dudit règlement ainsi que la prise en compte de ces contrats dans les calculs relatifs au seuil de compensation conformément à l'article 10 dudit règlement.
4. By 1 January 2018 the Commission shall prepare a report, after consulting ESMA and ACER, assessing the potential impact on energy prices and on the functioning of the energy market as well as the feasibility and the benefits in terms of reducing counterparty and systemic risks and the direct costs of C6 energy derivative contracts being made subject to the clearing obligation set out in Article 4 of Regulation (EU) No 648/2012, the risk mitigation techniques set out in Article 11(3) thereof and their inclusion in calculating the clearing threshold pursuant to Article 10 thereof.

where the Council has endorsed the corrective action plan submitted by the concerned Member State in accordance with Article 8(2) of Regulation (EU) No 1176/2011 on the prevention and correction of macro-economic imbalances or the excessive imbalance procedure is placed in a position of abeyance in accordance with Article 10(5) of that Regulation or the Council has closed the excessive imbalance procedure in accordance with Article 11 of that Regulation;

(5) L’article 11, paragraphe 3, du règlement (CE) n° 73/2009 établit que, dans le cadre de l’application des paliers définis dans le calendrier prévu à l’article 121 dudit règlement à tous les paiements directs octroyés dans les nouveaux États membres au sens de l'article 2, point g), dudit règlement, la discipline financière ne s'applique aux nouveaux États membres qu'à compter du début de l'année civile pendant laquelle le niveau des paiements directs applicable dans les nouveaux États membres est au moins égal au niveau de ces paiements applicable dans les autres États membres.
(5) Article 11(3) of Regulation (EC) No 73/2009 lays down that in the framework of the application of the schedule of increments provided for in Article 121 of that Regulation to all direct payments granted in the new Member States within the meaning of Article 2(g) of that Regulation, the financial discipline should not apply to the new Member States until the beginning of the calendar year in respect of which the level of direct payments applicable in the new Member States is at least equal to the then applicable level of such payments in the other Member States.

Article 11(1) of Regulation (EC) No 73/2009 also lays down that an adjustment of the direct payments (financial discipline) has to be determined when the forecasts for the financing of the direct payments and market related expenditures, increased by the amounts resulting from the application of Articles 10b and 136 of that Regulation but before the application of Article 10a thereof and without taking into account the margin of EUR 300 000 000, indicate that the annual ceiling will be exceeded.

5. Tout acte délégué adopté conformément à l’article 11 n’entre en vigueur que si le Parlement européen ou le Conseil n’a pas exprimé d’objections dans un délai de deux mois à compter de la notification dudit acte au Parlement européen et au Conseil ou si, avant l’expiration dudit délai, le Parlement européen et le Conseil ont tous deux informé la Commission qu’ils ne comptaient pas exprimer d’objection.
5. A delegated act adopted pursuant to Article 11 shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object.
