(5) L’article 11, paragraphe 3, du règlement (CE) n° 73/2009 établit que, dans le cadre de l’application des paliers définis dans le calendrier prévu à l’article 121 dudit règlement à tous les paiements directs octroyés dans les nouveaux États membres au sens de l'article 2, point g), dudit règlement, la discipline financière ne s'applique aux nouveaux États membres qu'à compter du début de l'année civile pendant laquelle le niveau des paiements directs applicable dans les nouveaux États membres est au moins égal au niveau de ces paiements applicable dans les autres États membres.
(5) Article 11(3) of Regulation (EC) No 73/2009 lays down that in the framework of the application of the schedule of increments provided for in Article 121 of that Regulation to all direct payments granted in the new Member States within the meaning of Article 2(g) of that Regulation, the financial discipline should not apply to the new Member States until the beginning of the calendar year in respect of which the level of direct payments applicable in the new Member States is at least equal to the then applicable level of such payments in the other Member States.

(2) Where the applicant would be the beneficial owner of the permit, if granted, this Rule shall apply to that applicant, but where the applicant would not be the beneficial owner of the permit, if granted, this Rule shall be applied to the person or enterprise that would be the beneficial owner of the permit as if that person or enterprise were the applicant and where in this manner a Canadian participation rate is determined for a beneficial owner, that Canadian participation rate shall be deemed to be the Canadian participation rate of the applicant for the purposes of section 121.

4. 4. At any stage of the negotiations and from the end of the negotiations to the conclusion of the international agreement, Parliament may, on the basis of a report from the committee responsible, and after considering any relevant proposal tabled pursuant to Rule 121, adopt recommendations and require them to be taken into account before the conclusion of that agreement.
