3. a. Au cas où les opérations de crédit visées par la présente directive se trouvent soumises à des dispositions législatives nationales en vigueur le 1er mars 1990, qui imposent des limites maximales au taux annuel effectif global desdites opérations et qui permettent de ne pas prendre en considération, par rapport à ces limites maximales, des frais de nature forfaitaire, différents de ceux décrits au paragraphe 2 points i) à v), les États membres peuvent, exclusivement aux fins desdites opérations, ne pas prendre en considération lesdits frais pour le calcul du taux annuel effectif global, à condition que soit exigé, dans les cas visés à l'article 3 et dans le contrat de crédit, que le consommateur soit informé de leur montant et de leur inclusion dans les paiements à effectuer.
3 (a) Where credit transactions referred to in this Directive are subject to the provisions of national laws in force on 1 March 1990 which impose maximum limits on the annual percentage rate of charge for such transactions and, where such provisions permit standard costs other than those described in paragraph 2 (i) to (v) not to be included in those maximum limits, Member States may, solely in respect of such transactions, not include the aforementioned costs when calculating the annual percentage rate of charge, as stipulated in this Directive, provided that there is a requirement, in the cases mentioned in Article 3 and in the credit agreement, that the consumer be informed of the amount and inclusion thereof in the payments to be made.
