A. whereas the purpose of the Schools is to educate together children of the staff of the European Communities; whereas besides the children covered by the Agreements provided for in Articles 28 and 29 of the Statute of the European Schools, other children may attend the Schools within the limits set by the Board of Governors; whereas the recruitment and retention of suitably qualified officials is necessary for the smooth functioning of the European institutions, and whereas the provision of mother-tongue education for the children of such officials, the recognition of the equal value of academic years successfully completed in the Member States and at the European Schools, and the European Baccalaureate, all contribute to this,

CONSIDÉRANT que les dispositions du titre IV du traité instituant la Communauté européenne et des actes adoptés sur la base dudit titre ne s'appliquent pas au Royaume de Danemark en vertu du protocole sur la position du Danemark annexé par le traité d'Amsterdam au traité sur l'Union européenne et au traité instituant la Communauté européenne, mais qu'il convient de créer la possibilité pour la Confédération suisse et le Danemark d'appliquer, dans leurs relations mutuelles, les dispositions de fond du présent accord.
WHEREAS the provisions of Title IV of the Treaty establishing the European Community and the acts adopted on the basis of that Title do not apply to the Kingdom of Denmark pursuant to the Protocol on the position of Denmark annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community, but it should be made possible for the Swiss Confederation and Denmark to apply the substantive provisions of this Agreement in their relations with each other.

CONSIDÉRANT que le Conseil de l'Union européenne a adopté le règlement (CE) no 343/2003 du 18 février 2003 établissant les critères et mécanismes de détermination de l'État membre responsable de l'examen d'une demande d'asile présentée dans l'un des États membres par un ressortissant d'un pays tiers (ci-après dénommé «règlement Dublin»), qui a remplacé la convention de Dublin relative à la détermination de l'État responsable de l'examen d'une demande d'asile présentée dans l'un des États membres des Communautés européennes, signée à Dublin le 15 juin 1990 (ci-après dénommée «convention de Dublin»), et que la Commission des Communautés européennes a adopté le règlement (CE) no 1560/2003 du 2 septembre 2003 portant modalités d'application du règlement (CE) no 343/2003 du Conseil établissant les critères et mécanismes de détermination de l'État membre responsable de l'examen d'une demande d'asile présentée dans l'un des États membres par un ressortissant d'un pays tiers (ci-après dénommé «règlement modalités d'application de Dublin»).
WHEREAS the Council of the European Union has adopted Council Regulation (EC) No 343/2003 of 18 February 2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national (hereinafter referred to as the Dublin Regulation), which replaced the Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities, signed in Dublin on 15 June 1990 (hereinafter referred to as the Dublin Convention), and whereas the Commission of the European Communities has adopted Regulation (EC) No 1560/2003 of 2 September 2003 laying down detailed rules for the application of Council Regulation (EC) No 343/2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national, hereinafter referred to as the ‘Dublin implementing Regulation’.
