Par son arrêt de ce jour, la Cour répond que le droit de l’Union (notamment le principe de neutralité fiscale) ne s’oppose pas à ce que le transport urbain effectué, d’une part, en taxi et, d’autre part, en voiture de location avec chauffeur soit soumis à des taux de TVA distincts (l’un réduit, l’autre normal), dès lors que deux conditions sont remplies : 1) en raison des différentes exigences légales auxquelles sont soumis ces deux types de transport, le transport en taxi doit constituer un aspect concret et spécifique de la catégorie de services en cause (transport des personnes et des bagages qui les accompagnent) et 2) ces différences doivent avoir une influence déterminante sur la décision de l’usager moyen de recourir à l’un ou à l’autre de ces types de transport.
In its judgment delivered today, the Court replies by stating that EU law (in particular the principle of fiscal neutrality) does not preclude local urban transport carried out, on the one hand, by taxi and, on the other hand, by minicab from being subject to different rates of VAT (one a reduced rate and the other the standard rate), in so far as two conditions are satisfied: (1) by reason of the different statutory requirements to which those two types of transport are subject, transport by taxi must constitute a concrete and specific aspect of the category of services at issue (transport of passengers and their accompanying luggage); and (2) those differences must have a decisive influence on the decision of the average user to use one such type of transport or the other.

3. They welcomed the reaffirmation of support for this reform expressed by the members of the European Council in Paris on 18 November. 2. The 24 noted that: - more than one third of the 336 million ECU ($ 370 million) pledged for food assistance has been supplied and that the remaining two-thirds will be delivered shortly, mostly before the end of the year, in accordance with Polish needs and absorption capacities; - the Community has decided to increase the financial means for economic cooperation with Poland and Hungary in 1990 to 300 million Ecu and that the European Investment Bank with a three year horizon; - most members of the 24 including the Community have decided or envisaged to improve access to their markets for Polish and Hungarian exports notably through an extension of the generalized system of preferences; - the identification of projects in the four priority areas defined by the 24, agriculture, training, environment and investment, is well under way in close cooperation with the Polish and Hungarian authorities; - the coordination of these projects and other actions has been pursued in the working groups, each of which has met at least twice since the last Group of 24 meeting; the agricultural group has coordinated food supplies to avoid bottle-necks; the training group is examining programmes for local administrators, banking and financial staff and language teachers; the environment group is working on joint actions concerning air and water pollution, and waste management; the investment group is analysing the legal, fiscal and guarantee conditions favouring private investment and identifying sectors for foreign investment in close cooperation with the Polish and Hungarian authorities.
