TRADUCTIONS EN CONTEXTE

27. observe que l'ancien directeur exécutif de l'Agence a écrit à cette dernière le 28 décembre 2010 pour exposer les activités qu'il avait l'intention d'exercer à la fin de son mandat; estime que la première décision du 11 janvier 2011, prise par le président du conseil d'administration de l'Agence, qui autorisait les nouvelles activités de l'ancien directeur exécutif de l'Agence, constitue une infraction à la réglementation de l'Union relative aux conflits d'intérêts, en particulier au regard du titre II, article 16, du statut des fonctionnaires des Communautés européennes; rappelle que conformément au titre II, article 11, et au titre IV, article 91, du régime applicable aux autres agents des Communautés européennes, cette disposition s'applique par analogie aux agents temporaires et aux agents contractuels; estime que le fait que le conseil d'administration ait adopté, le 17 mars 2011, des restrictions aux futures activités de l'ancien directeur exécutif – uniquement après de vives protestations publiques – démontre à l'évidence qu'à l'origine, l'Agence n'a pas appliqué correctement le statut des fonctionnaires, ce qui, par voie de conséquence, soulève de graves doutes sur la façon dont elle applique la réglementation en général; demande au directeur exécutif de présenter un rapport détaillé sur l'application de l'article 16 du statut des fonctionnaires au sein de l'Agence;
27. Notes that the former Executive Director of the Agency wrote to the Agency on 28 December 2010 outlining the activities which he was intending to take up at the end of his term of office; considers the first decision of 11 January 2011, taken by the Chairman of the Agency Management Board, to authorise the new activities of the former Executive Director of the Agency to be a breach of Union rules relating to conflicts of interest, in particular with regard to Title II, Article 16, of the Staff Regulations of the Officials of the European Communities; recalls that according to Title II, Article 11, and title IV, Article 91, of the Conditions of Employment of Other Servants of the European Communities, this provision applies by analogy to temporary agents and to contract employees; considers the fact that the Management Board adopted limitations on the future activities of the former Executive Director on 17 March 2011 - only after strong public protest - to be clear proof that the Agency did initially not apply the Staff Regulations properly, which in turn raises serious questions about their application of the rules in general; asks the Executive Director to present a detailed report on the implementation of Article 16 of the Staff Regulations within the Agency;

Calls further on the Commission to propose, in the light of the relevant case law of the Court of Justice of the European Communities, the necessary changes to the overarching Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities' financial interests ; points out that those changes now must be adopted under the codecision procedure;

38. invite les États membres qui ne l'ont pas encore fait à ratifier la convention de 1995 sur la protection des intérêts financiers des Communautés européennes, rappelant qu'ils s'étaient engagés à le faire pour la mi-1998 et soulignant que cette ratification deviendra inutile à partir du moment où la Commission aura présenté une proposition d'acte communautaire;
38. Calls on those Member States which have not yet done so to ratify the 1995 Convention on the Protection of the European Communities' Financial Interests, noting that they undertook to do so by the middle of 1998 and emphasising that such ratification will become pointless once the Commission has submitted a proposal for a Community act;

LE CONSEIL DES COMMUNAUTÉS EUROPÉENNES ET LES MINISTRES DE LA SANTÉ DES ÉTATS MEMBRES, RÉUNIS AU SEIN DU CONSEIL, vu les traités instituant les Communautés européennes, considérant leur approche commune en matière de lutte contre le SIDA, dégagée dès 1986 et développée depuis (1), demeurent préoccupés par la progression de l'épidémie de SIDA dans les États membres de la Communauté et par ses conséquences sociales, économiques, juridiques et éthiques; rappellent leurs conclusions du 16 mai 1989 (2) affirmant que la contamination par injection de drogue est une préoccupation majeure des responsables de la santé; soulignent les très grands efforts entrepris par tous les États membres dans les domaines de la recherche, du traitement et de la prévention ainsi que l'important effort de coordination de la recherche entrepris au niveau communautaire; constatent que, malgré les progrès encourageants réalisés dans la recherche, des vaccins et traitements efficaces ne seront pas largement disponibles avant plusieurs années; rappellent l'importance de la coopération internationale, notamment avec l'Organisation mondiale de la santé (OMS) et le Conseil de l'Europe; considèrent comme opportun de réaffirmer et de préciser, à l'intention de tous les citoyens européens, les principes qui doivent guider la prévention et la lutte contre le SIDA; rappellent en outre leurs conclusions du 15 mai 1987 (3) décidant l'élaboration d'un plan d'action et de coordination à retenir par les États membres et sur le plan communautaire; conviennent à cette fin de renforcer la coordination des actions nationales et communautaires et de promouvoir des activités d'intérêt commun.
THE COUNCIL OF THE EUROPEAN COMMUNITIES AND THE MINISTERS FOR HEALTH OF THE MEMBER STATES, MEETING WITHIN THE COUNCIL, Having regard to the Treaties establishing the European Communities, Having regard to their common approach to combating AIDS, worked out in 1986 and subsequently expanded (1), Remain concerned by the increase in the AIDS epidemic in the Member States of the Community and by its social, economic, legal and ethical consequences; Recall their conclusions of 16 May 1989 (2) affirming that contamination by drug injection is a major concern of the health authorities; Stress the very considerable efforts made by all Member States in the fields of research, treatment and prevention as well as the major endeavour to coordinate research at Community level; Note that, in spite of encouraging progress achieved in research, effective vaccines and treatment will not be widely available for several years; Reiterate the importance of international cooperation, in particular with the World Health Organization (WHO) and the Council of Europe; Consider it advisable to reaffirm and specify, for the attention of all European citizens, the principles which should guide them in preventing and combating AIDS; Draw attention also to their conclusions of 15 May 1987 (3) in which they decided to draw up an action and coordination plan for adoption by the Member States and at Community level; Therefore agree to step up the coordination of national and Community projects and promote activities of common interest.
