Avant qu’une mesure particulière d’harmonisation au titre de la décision no 676/2002/CE du Parlement européen et du Conseil du 7 mars 2002 relative à un cadre réglementaire pour la politique en matière de spectre radioélectrique dans la Communauté européenne (décision «spectre radioélectrique») soit proposée, il convient que la Commission effectue des analyses d’impact relatives aux coûts et aux avantages des mesures proposées, par exemple en termes d’économies d’échelle et d’interopérabilité des services au profit des consommateurs, à l’incidence sur l’efficacité de l’utilisation du spectre ou aux demandes concernant une utilisation harmonisée dans les différentes parties de l’Union européenne.
Before a specific harmonisation measure under Decision No 676/2002/EC of the European Parliament and of the Council of 7 March 2002 on a regulatory framework for radio spectrum policy in the European Community (Radio Spectrum Decision) is proposed, the Commission should carry out an impact assessment on the costs and benefits of the proposed measure, such as the realisation of economies of scale and the interoperability of services for the benefit of consumers, the impact on efficiency of spectrum use, or the demand for harmonised use in the different parts of the European Union.

En outre, si, à la clôture du programme, le montant de la contribution communautaire effectivement dépensé au profit des opérations visées à l’article 16 bis, paragraphe 1, points a) à f), est inférieur au montant visé au paragraphe 5 bis, premier alinéa, du présent article, l’État membre rembourse au profit du budget général des Communautés européennes le solde correspondant, à hauteur d’un montant égal à la part de la contribution communautaire dépensée au profit des opérations visées à l’article 16 bis, paragraphe 1, point g), qui dépasse les crédits disponibles conformément au paragraphe 5 bis, quatrième alinéa, du présent article.
In addition, if, at the closure of the programme, the actual amount of Community contribution spent on the operations referred to in points (a) to (f) of Article 16a(1) is lower than the amount referred to in the first subparagraph of paragraph 5a of this Article, the difference shall be reimbursed by the Member State to the general budget of the European Communities up to the amount by which the amount of Community contribution spent on the operations referred to in point (g) of Article 16a(1) has exceeded the allocations available under the fourth subparagraph of paragraph 5a of this Article.

Pour les motifs susmentionnés, on peut en conclure que l'accord entre la Communauté européenne et la Côte d'Ivoire est profitable aux deux parties contractantes.
For the above reasons, it can be concluded that the agreement between the European Community and the Republic of Côte d’Ivoire offers benefits for both contracting parties.

Notes that the issue of making available to insurance companies the results of genetic tests carried out before conclusion of an insurance policy is not governed by Community legislation and that national laws and practices vary from country to country; calls on the Commission, therefore, to propose suitable draft legislation on the basis of Article 47(2) in conjunction with Article 55 of the TEC, including a ban on the use of personal medical information such as genetic typology which might lead to discrimination with regard to the issuing of insurance policies, and the possibility of applying a limit on insurance in specific cases;
