TRADUCTIONS EN CONTEXTE

Les dispositions existantes des traités (article 42 du traité sur l’Union européenne et article 67, paragraphe 2, du traité instituant la Communauté européenne) offrent déjà la possibilité de modifier ces modalités, ce qui améliorerait la prise de décision au Conseil, permettrait au Parlement européen d’exercer convenablement son contrôle démocratique et renforcerait le rôle de la Cour de justice.

Dans le traitement d’une pétition, ce n’est pas le rôle mais la crédibilité de ce Parlement qui est en jeu. When it is dealing with a petition, not the role, but the credibility of this Parliament is at stake. 12. Reaffirms paragraph 2 of its abovementioned resolution of 16 May 2000 on protecting the Communities' financial interests and calls on the Commission, as a preliminary step, to present, on the basis of the current Article 280 of the EC Treaty, a proposal to extend Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;

11. se félicite donc de la démarche de la Commission qui, à l'instar du Parlement européen et de la Cour des comptes (cf. contribution à la CIG), a saisi la Conférence intergouvernementale d'une proposition de modification du traité sous forme de l'article 280bis du traité CE, en vue de permettre l'institution d'un procureur européen compétent pour la protection des intérêts financiers des Communautés, ce qui permettrait d'assurer la cohérence des investigations sur l'ensemble du territoire de la Communauté européenne;
11. Welcomes, therefore, the Commission's approach in submitting to the Intergovernmental Conference, like Parliament and the Court of Auditors (cf. contribution to the IGC) before it, a proposal for amending the EC Treaty by adding an Article 280a, so that a European Public Prosecutor's Office with responsibility for the protection of the Communities' financial interests can be established, which would ensure consistency between investigations conducted throughout the territory of the European Community;

2. invite la Commission à présenter, pour le 30 juin 2000 au plus tard, sur la base de l'article 280 du traité CE, à titre de première étape dans la voie de la création de ce ministère public européen et conformément aux propositions faites à cet égard par le comité d'experts indépendants, une proposition qui, complétant le règlement instituant l'OLAF , permettrait de désigner rapidement un procureur européen, dont, jusqu'à l'entrée en vigueur de la modification du traité, la compétence serait limitée aux délits commis par des membres et des agents des institutions de l'Union européenne au détriment des intérêts financiers des Communautés européennes et qui aurait pour mission de conduire les enquêtes menées par l'OLAF concernant ces délits et de faciliter, à leur propos, les poursuites devant les juridictions nationales appropriées;
2. Calls on the Commission, as a preliminary step and in anticipation of such a European public prosecutor's office, to present by 30 June 2000 at the latest, on the basis of Article 280 of the EC Treaty, in accordance with the corresponding proposals made by the Committee of Independent Experts, a proposal to extend the OLAF Regulation , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;
