L’article 10 CE, en liaison avec le régime applicable aux autres agents des Communautés européennes établi par le règlement (CEE, Euratom, CECA) no 259/68 du Conseil, du 29 février 1968, fixant le statut des fonctionnaires des Communautés européennes ainsi que le régime applicable aux autres agents de ces Communautés, et instituant des mesures particulières temporairement applicables aux fonctionnaires de la Commission, tel que modifié par le règlement (CE, Euratom) no 723/2004 du Conseil, du 22 mars 2004, s’oppose à une réglementation d’un État membre, telle que celle en cause au principal, interprétée en ce sens que, pour l’admissibilité au bénéfice des allocations de chômage, ne sont pas prises en compte les périodes de travail accomplies en qualité d’agent contractuel au sein d’une institution de l’Union européenne établie dans cet État membre et ne sont pas assimilées à des journées de travail les journées de chômage ayant donné lieu au versement d’une allocation de chômage en application du régime applicable aux autres agents des Communautés européennes, alors que les journées de chômage indemnisées en vertu de la réglementation dudit État membre bénéficient d’une telle assimilation.
Article 10 EC, in conjunction with the Conditions of Employment of Other Servants of the European Communities established by Regulation (EEC, Euratom, ECSC) No 259/68 of the Council of 29 February 1968 laying down the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities and instituting special measures temporarily applicable to officials of the Commission, as amended by Council Regulation (EC, Euratom) No 723/2004 of 22 March 2004, precludes legislation of a Member State, such as that at issue in the main proceedings, which is interpreted as meaning that, in relation to eligibility for unemployment benefit, periods of work completed as a member of the contract staff in an institution of the European Union established in that Member State are not taken into account and days of unemployment which have given rise to payment of an unemployment allowance pursuant to the Conditions of Employment of Other Servants of the European Communities are not treated as working days although days of unemployment for which benefit has been paid under the legislation of that Member State are so treated.
