Depuis l'entrée en vigueur du traité de Lisbonne, ce n'est plus la Communauté européenne mais l'Union européenne qui doit, formellement, approuver l'accord: la décision du Conseil vise dès lors, non seulement à approuver l'accord au nom de l'Union européenne, mais aussi à notifier officiellement à la partie sud-africaine qu'à compter du 1er décembre 2009, l'Union européenne, ayant succédé à la Communauté européenne, exerce tous les droits et obligations de cette dernière, et, en particulier, ceux découlant de cet accord.
When the Treaty of Lisbon came into force, the European Union succeeded the European Community as the body required formally to approve the agreement. The purpose of the Council decision is therefore not only to approve the agreement on behalf of the European Union, but also to give official notification to South Africa that, as from 1 December 2009, the European Union, having succeeded the European Community, exercises all rights and assumes all obligations of the Community, in particular those deriving from this agreement.

Even if there is no explicit reference to external competence in the EC Treaty, it results from the jurisprudence of the Court of Justice of the European Communities that the provisions of the EC Treaty referred to above constitute legal bases not only for internal acts of the Community, but also for the conclusion of international agreements by the Community.

L’importance du rôle du Parlement dans l’adoption du traité instituant la Communauté de l’énergie se reflète aussi dans le choix de la base juridique, c’est-à-dire dans le fait que le Parlement ait un droit d’avis conforme, comme prévu à l’article 300, paragraphe 3, du traité instituant la Communauté européenne.
The importance of Parliament’s role in the adoption of the Energy Community Treaty is also reflected in the choice of legal basis, that is to say, in the fact that Parliament has a right of assent, as stated in Article 300(3) of the Treaty establishing the European Community.

À ce titre, les rédacteurs de la Charte ont eu le souci constant d'éviter - ce qui figurait aussi dans le cahier des charges - tout risque de divergence de jurisprudence entre la Cour européenne des droits de l'homme, responsable du respect de la Convention, et la Cour de justice des Communautés européennes, notamment en reprenant la rédaction issue de la Convention du Conseil de l'Europe lorsque celle-ci paraissait suffisamment aboutie.
In this respect, the authors of the Charter were careful throughout, as was also stipulated in the specification, to avoid any risk of conflict between the case law of the European Court of Human Rights, responsible for ensuring compliance with the Convention, and that of the European Court of Justice, in particular by adopting the wording used by the Council of Europe Convention when this seemed sufficiently finalised.
