Expects the Commission to work on the quality of the national declarations (26 Member States delivered a summary of EU expenditure, as provided for by point 44 of the Interinstitutional Agreement between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management and Article 53b of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities ) in order to make them usable by the European Court of Auditors; expects a very early report on the quality of these summaries and proposals on how to improve their quality; underlines, also, the importance implementing the decisions on the 2006 discharge of the general budget, in particular the Structural Funds Action Plan and the follow-up of use of EU funds in external actions;

Recalls that, as a result of such smuggling, the Community and Member States' budgets year after year suffer losses of revenue amounting to several billion euro; instructs its President to initiate the necessary steps without delay so that Parliament can assist the Commission as an intervening party against the tobacco concerns which have brought an action against the Commission before the Court of Justice of the European Communities in Luxembourg because they wish to have it denied the right to bring legal action against them in the USA;

7. exige que la Commission, sur la base de l'article 274 du Traité instituant la Communauté européenne, prenne, lorsqu'elle octroie une aide financière substantielle au budget d'organisations, les mesures appropriées pour sauvegarder les intérêts financiers de la Communauté, en ce compris, si la chose est nécessaire et réalisable, l'adoption et la gestion par le bénéficiaire de règles et de procédures qui permettent de garantir une gestion saine et un contrôle interne fiable; insiste auprès de l'OHR pour une coopération optimale; se félicite de l'introduction récente d'audits systématiques ex post de la mise en œuvre d'octroi de projets financés sur des aides non remboursables à des bénéficiaires qui ne sont pas des organisations internationales; demande à la Commission de fournir au Parlement européen un aperçu et une évaluation de tous les audits ex post effectués, dès le lancement de chaque procédure de décharge; s'engage à vérifier, dans le cadre de la prochaine procédure de décharge, si l'accord conclu le 9 août 1999 entre l'UE et l'ONU offre des garanties suffisantes pour une gestion saine et un contrôle financier fiable;
7. Urges the Commission pursuant to Article 274 of the EC Treaty, where it contributes substantially to the budgets of organisations, to take the appropriate measures to safeguard the Community's financial interests including if necessary and feasible the adoption and operation by the beneficiary of rules and procedures which can guarantee proper administration and internal control; urges the OHR to cooperate optimally; notes with approval the recent introduction of systematic ex post audits of the implementation of project grants to beneficiaries which are not international organisations; calls on the Commission, at the beginning of each discharge procedure, to provide the European Parliament with an overview and evaluation of all ex post audits performed; undertakes in connection with the forthcoming discharge procedure to investigate whether the agreement of 9 August 1999 between the EU and the UN provides adequate guarantees of proper administration and financial control;

However, for legal reasons we think that it is wrong to refer to it at this early stage in Article 6 of the Treaty on European Union, because it was not possible to reach formal agreement on it within the convention, reflecting its structure, and it therefore has no legal status.

The Commission's 2001-2003 Action Plan follows on directly from the overall strategic approach to the protection of financial interests and the fight against fraud, adopted in July 2000. It sets out to make an effective contribution to the new obligations on Member States and the European Community to achieve results, arising from the new Article 280 of the EC Treaty.
