Par dérogation à l’article 31, paragraphe 2, à l’article 32, paragraphe 4, et à l’article 37, paragraphe 1, du règlement (CE) no 1260/1999 du Conseil du 21 juin 1999 portant dispositions générales sur les Fonds structurels (10), les parties des sommes engagées pour les interventions cofinancées par le FEOGA, section «Orientation», approuvées par la Commission entre le 1er janvier 2000 et le 31 décembre 2006, et pour lesquelles l’état certifié des dépenses effectivement supportées, le rapport final d’exécution et la déclaration visée à l’article 38, paragraphe 1, point f), dudit règlement n’ont pas été transmis à la Commission dans les quinze mois suivant la date ultime d’éligibilité des dépenses visée dans la décision d’octroi d’une contribution des fonds, sont dégagées d’office par la Commission, au plus tard six mois après l’échéance et donnent lieu à la restitution des sommes indues.
By way of derogation from Articles 31(2), 32(4) and 37(1) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural funds (10), partial sums committed for assistance co-financed by the EAGGF Guidance Section approved by the Commission between 1 January 2000 and 31 December 2006, for which the certified statement of expenditure actually paid, the final report on implementation and the statement referred to in Article 38(1)(f) of that Regulation have not been sent to the Commission within 15 months after the final date of eligibility of expenditure laid down in the decision granting a contribution from the Funds, shall be automatically de-committed by the Commission not later than 6 months after that deadline, giving rise to the repayment of amounts unduly paid.

Les sommes engagées pour le financement des actions de développement rural par le FEOGA, section «Orientation», en vertu d'une décision de la Commission adoptée entre le 1er janvier 2000 et le 31 décembre 2006, pour lesquelles les documents nécessaires à la clôture des interventions n'ont pas été communiqués à la Commission à l'issue du délai de transmission du rapport final, sont dégagées d'office par la Commission au plus tard le 31 décembre 2010 et donnent lieu au remboursement par les États membres des sommes indûment perçues.
1. Amounts committed to finance rural development measures from the EAGGF Guidance Section under a Commission decision adopted between 1 January 2000 and 31 December 2006, in respect of which the documents required for closure of the assistance have not been sent to the Commission by the end of the time allowed for transmission of the final report, shall be automatically decommitted by the Commission no later than 31 December 2010 and shall result in the reimbursement by the Member States of amounts wrongly received.

S'il ressort des rapports des États membres ou d'autres sources que les régimes nationaux comportent encore des éléments d'aide d'État, la Commission appréciera ces aides sur la base des articles 92 et 93 du traité, conformément aux orientations énoncées ci-dessus.
Should it appear either through those reports or otherwise that the systems in operation in the Member States still involve State aid, the Commission will assess such aid pursuant to Articles 92 and 93 of the Treaty, in accordance with the policy set out above.
