Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

At its meeting of 11 June 2007 the Legal Affairs Committee decided, as the establishment of the Joint/Mixed Committees entails the creation of an organisation structure with a discretion to take decision binding on the contracting parties, in particular with regard to the maintenance of the Agreement and dispute resolution and as the Protocol extends the Joint/Mixed Committees by including Liechtenstein as a contracting party, to recommend that he legal basis should be changed so as to refer to the second subparagraph of Article 300(3) of the EC Treaty, which requires the assent and not merely consultation of the European Parliament.

Calls on the Commission to keep it fully informed, in accordance with the undertakings given by the Commissioner for Trade during the EP hearings, before and, to an equal extent, during the Ministerial Conference in Seattle and throughout the Millennium Round, and to discuss with it, as soon as possible in accordance with a strict timetable laid down after the Seattle Ministerial Conference on the basis of the resolutions adopted by Parliament, in the form of an ongoing and wide-ranging consultation the essential elements of the EU's negotiating strategy; underlines the urgent need for new procedures which will ensure full provision of information to it on the work and calendar of and the decisions taken by the 133-committee;
