TRADUCTIONS EN CONTEXTE

La 17 conférence des parties à la convention des Nations unies relative au commerce des espèces menacées d’extinction (CoP17 de la CITES) se tiendra du 24 septembre au 5 octobre 2016 à Johannesbourg, en Afrique du Sud. Elle offre aux parties l'occasion, d'une part, d'examiner la façon dont est mise en œuvre la CITES, qui couvre plus de 35 000 espèces de faune et de flore et qui est destinée à garantir la légalité, la traçabilité et la durabilité du commerce, et, d'autre part, d'adopter de nouvelles mesures contraignantes pour la protection des espèces sauvages.
The 17th Conference of the Parties to the UN Convention on Trade in Endangered Species (CITES CoP17) will take place between 24 September and 5 October 2016 in Johannesburg, South Africa.It provides a forum for Parties to review the implementation of the CITES Convention, which covers more than 35 000 plants and animals, ensuring that trade remains legal, traceable and sustainable, and to adopt new binding measures for wildlife protection.

It is clear from the documents referred to and submitted by the French authorities that in 1997 the remuneration the state as shareholder expected from EDF for the whole period 1997-2000 was FRF 9,4 billion, of which FRF 6 billion was in respect of the portion at the fixed rate of 3 % and EUR 3,4 billion for the whole period in respect of the supplementary portion, after the reclassification made by Act No 97-1026.

With regard to the claims for the Tribunal, first, to order the applicant’s post to be regraded to a grade corresponding to the level of his responsibilities and, secondly, to order the EEAS to bear all the consequences, in particular the financial consequences, of that regrading, retrospectively from the time of his entry into the service, it should be noted that, in the context of an action brought under Article 91 of the Staff Regulations, the court may not, without encroaching upon the powers of the administration, make declarations or findings of principle, or issue directions to an institution (see order in Caminiti v Commission, F‑71/09, EU:F:2011:53, paragraph 23 and the case-law cited therein).

In order to address the above issues in an effective, transparent, timely and flexible manner beyond the expiry of Council Regulation (EC) No 975/1999 of 29 April 1999 laying down the requirements for the implementation of development cooperation operations which contribute to the general objective of developing and consolidating democracy and the rule of law and to that of respecting human rights and fundamental freedoms (9) and Council Regulation (EC) No 976/1999 of 29 April 1999 laying down the requirements for the implementation of Community operations, other than those of development cooperation, which, within the framework of Community cooperation policy, contribute to the general objective of developing and consolidating democracy and the rule of law and to that of respecting human rights and fundamental freedoms in third countries (10), which served as the legal base for the European Initiative for Democracy and Human Rights and which expire by 31 December 2006, there is a need for specific financial resources and a specific financing instrument that can continue to work in an independent manner whilst remaining complementary to and reinforcing related Community instruments for external assistance, the Partnership Agreement between the Members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part (11), and humanitarian aid.

In accordance with established case-law, the distinctive character of a trade mark, within the meaning of Article 7(1)(b) of Regulation No 40/94, must be assessed, firstly, by reference to the goods or services in respect of which registration has been applied for and, secondly, by reference to the perception of them by the relevant public, which consists of average consumers of the goods or services in question, who are reasonably well informed and reasonably observant and circumspect (see Joined Cases C‑456/01 P and C‑457/01 P Henkel v OHIM [2004] ECR I‑5089, paragraph 35 and case-law cited).

Whereas the study carried out by the Commission demonstrates that it is possible to reduce the maximum methyl alcohol content to levels similar to those laid down for fruit spirits in Regulation (EEC) No 1576/89 although such a reduction would be difficult, particularly for small distilleries which do not have adequate technical and financial resources to comply quickly with a maximum limit fixed at a lower level; whereas it would be advisable for health reasons to reduce the methyl alcohol content of all fruit spirits to the lowest possible levels; whereas it is therefore proposed to introduce gradually and in stages a new maximum limit for the methyl alcohol content of the fruit spirits listed in Article 6 of Regulation (EEC) No 1014/90;
