(Return tabled) Question No. 129 Mr. Alex Atamanenko: With regard to the horse slaughter industry in Canada: (a) what is the government’s policy on requiring medical history on equine identity documents (EID) only for the last six months of a horse’s life, and not for an entire lifespan; (b) does the government have information on what happened to the meat from the racehorse Backstreet Bully, who had been administered several courses of a variety of banned medications throughout its lifetime, prior to being sold into the slaughter pipeline, and what are the details of Backstreet Bully’s EID and all other traceability documents and records; (c) does the government have information on what happened to the meat from the racehorse Silky Shark, who had been administered the drug phenylbutazone prior to being sold into the slaughter pipeline, and what are the details of Silky Shark’s EID and all other traceability documents and records; (d) what system is in place for owners to report the history of banned drugs they have administered to a horse that they previously owned, when they discover that a subsequent owner has sold that horse into the slaughter pipeline; (e) when such instances as mentioned in (d) are reported, and it is found that the meat was sold as human food, what system is in place to recall that meat from domestic and international retailers, (i) how many such instances have been reported, (ii) what were the results of the government’s investigations into these reports; (f) how does the government keep count of the number of horses being imported from the United States (U.S) for slaughter; (g) how does the government explain the discrepancy between the Canadian Food Inspection Agency (CFIA)/Agriculture Canada and U.S. Department of Agriculture figures; (h) what were the findings of the government’s investigation into the large numbers of emaciated horses arriving from the U.S. in 2011 destined for Les Viandes de la Petite-Nation slaughter plant, and ...

Irwin Cotler: With regard to international treaties and conventions dealing in whole or in part with human rights and with Canada’s international obligations in this regard: (a) does the government have any formal or informal procedures for regular review of those international human rights treaties that Canada has not yet signed, ratified, or otherwise accepted; (b) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking conflicts with the Constitution Act, 1867, and if so where can these guidelines be accessed; (c) do the guidelines referred to in (b) specify the standard according to which the government determines if any obligation contained in a treaty or other international undertaking violates any section of the Constitution Act, 1867; (d) has the government engaged in any review of its obligations under the Convention on the Elimination of Racial Discrimination (CERD); (e) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking require implementing legislation in order for Canada to be able to ratify or otherwise accept it, and if so where can these guidelines be accessed; (f) does the government have a position as to whether international agreements that establish a complaints mechanism or communications procedure for enforcement of the rights and obligations contained therein are necessarily unconstitutional; (g) does the government have a policy as to whether Canada will accept such agreements referred to in (f); (h) does the government undergo review of proposed international human rights agreements that would establish such a mechanism or procedure referred to in (f) on a case by case basis, (i) who is involved in this review, (ii) are the provinces and other inte ...

Notes that, according to Special Report No 2/2011, “there is still no independent control of the legality of investigative acts in progress, nor is there a code guaranteeing that investigative acts follow a predictable course”, notwithstanding repeated announcements made by OLAF in the past; notes, furthermore, that although there is an explicit will in the Commission’s amended proposal for a Regulation amending Regulation (EC) No 1073/1999 (COM(2011)0135) to put in place a review procedure, this will not be equal to an independent control of the legality of individual investigations and is thus even weaker in this regard than the initial proposal; recalls that this is a key demand, reflected also in the case-law of the Court of Justice; therefore considers it a must to ensure such a control mechanism, not only in order to protect the rights of the persons or economic operators concerned but also to protect the rights of the investigators of OLAF from legal proceedings initiated by those persons or economic operators; also stresses the need for a clear mandate for OLAF with regard to the other institutions of the Union;

J'exhorte seulement chacun à user de prudence et à ne pas répéter les récits erronés parce qu'il est impossible ensuite d'y mettre un terme, et ce qui se passe au pays actuellement est la répétition incessante de ces récits: le gouvernement a volé l'argent, le gouvernement ne va pas vous traiter équitablement; le compte en fiducie est menacé.
I would just urge real caution on everyone's part not to repeat erroneous stories, because it's impossible to pull them back in again, and what's happened around the country right now is a repetition of these stories again and again: the government has stolen the money; the government is not going to treat you fairly; the trust account is in jeopardy.

(19) Whereas existing international co-production agreements must be interpreted in the light of the economic purpose and scope envisaged by the parties upon signature; whereas in the past international co-production agreements have often not expressly and specifically addressed communication to the public by satellite within the meaning of this Directive a particular form of exploitation; whereas the underlying philosophy of many existing international co-production agreements is that the rights in the co-production are exercised separately and independently by each co-producer, by dividing the exploitation rights between them along territorial lines; whereas, as a general rule, in the situation where a communication to the public by satellite authorized by one co-producer would prejudice the value of the exploitation rights of another co-producer, the interpretation of such an existing agreement would normally suggest that the latter co-producer would have to give his consent to the authorization, by the former co-producer, of the communication to the public by satellite; whereas the language exclusivity of the latter co-producer will be prejudiced where the language version or versions of the communication to the public, including where the version is dubbed or subtitled, coincide(s) with the language or the languages widely understood in the territory allotted by the agreement to the latter co-producer; whereas the notion of exclusivity should be understood in a wider sense where the communication to the public by satellite concerns a work which consists merely of images and contains no dialogue or subtitles; whereas a clear rule is necessary in cases where the international co-production agreement does not expressly regulate the division of rights in the specific case of communication to the public by satellite within the meaning of this Directive;
