H. considérant que dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission , la Cour a annulé le règlement (CE) n° 881/2002, pour autant qu'il concernait M. Yassin Abdullah Kadi et Al Barakaat International Foundation, et a considéré que l'autorité communautaire qui décide de geler les fonds et les ressources économiques d'un individu ou d'une entité conformément au règlement (CE) n° 881/2002 doit l'informer des raisons sur lesquelles elle fonde sa décision afin de respecter les droits de la défense, en particulier le droit à être entendu et le droit à révision judiciaire, et que, compte tenu du fait que ces personnes ou entités n'étaient pas informées des charges accumulées contre elles, elles n'ont pas été en mesure de défendre leurs droits vis-à-vis de ces charges dans des conditions satisfaisantes devant la juridiction communautaire,
H. whereas in the above-mentioned Case Kadi and Al Barakaat International Foundation v Council and Commission , the Court of Justice annulled Regulation (EC) No 881/2002, in so far as it concerned Mr Yassin Abdullah Kadi and Al Barakaat International Foundation, and considered that the Community authority deciding to freeze the funds and economic resources of an individual or entity in accordance with Regulation (EC) No 881/2002 must communicate the grounds on which that decision is based to the individual or entity concerned, in order to observe the rights of defence, in particular the right to be heard and the right to judicial review, and that, given that those persons or entities were not informed of the evidence adduced against them, they had also been unable to defend their rights with regard to that evidence in satisfactory conditions before the Community judicature,

H. considérant que dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission, la Cour a annulé le règlement (CE) n° 881/2002, pour autant qu'il concernait M. – having regard to the relevant case-law of the Court of Justice of the European Communities and in particular its judgment of 3 September 2008 in Joined Cases C-402/05 P and C-415/05 P, Kadi and Al Barakaat International Foundation v Council and Commission ,

11. s'interroge, en ce qui concerne "l'exposé des motifs" qui doit être publié, sur la question de savoir si la proposition de la Commission et le document du Conseil respectent l'arrêt rendu dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission , qui renvoie à l'obligation de communiquer les motifs justifiant, dans ces cas, l'inclusion du nom d'une personne ou d'une entité dans la liste, en tenant tout particulièrement compte du droit des personnes et entités concernées d'être informées des éléments retenus à leur charge;
11. Queries, in relation to the "statement of reasons" to be provided, whether either the Commission proposal or the Council text complies with the requirements of the judgment in the above-mentioned Case Kadi and Al Barakaat International Foundation v Council and Commission , which referred to the obligation to communicate the grounds on which, in such cases, the name of a person or entity is included in the list, taking into particular account the right of persons and entities concerned to be informed of the evidence against them;
