Il découlerait de la jurisprudence de la Cour que la nécessité d’une notification préalable d’une mesure de gel de fonds connaît des exceptions, en particulier dans le cas d’une décision initiale de gel, lorsqu’une telle notification nuirait à l’efficacité de telles mesures restrictives (arrêt du 3 septembre 2008, Kadi et Al Barakaat International Foundation/Conseil et Commission, C‑402/05 P et C‑415/05 P, Rec. p. I‑6351, points 339 à 341).
The Court’s case-law makes it clear that the requirement of prior notification of a fund-freezing measure is subject to exceptions, in particular in the case of an initial decision to freeze, when such notification would harm the effectiveness of those restrictive measures (Joined Cases C‑402/05 P and C‑415/05 P Kadi and Al Barakaat International Foundation v Council and Commission [2008] ECR I‑6351, paragraphs 339 to 341).

The principles thus referred to by the General Court, and not challenged by the French Republic, may also be found in the Court of Justice’s case-law (see, in connection with Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan (OJ 2002 L 139, p. 9), Kadi and Al Barakaat v Council and Commission, paragraphs 338 to 341).

Si, ainsi qu’il a été rappelé au point 61 du présent arrêt, une exception audit droit fondamental a été admise pour ce qui concerne les décisions initiales de gel de fonds, celle-ci se justifie par la nécessité d’assurer l’efficacité des mesures de gel et, en définitive, par des considérations impérieuses touchant à la sûreté ou à la conduite des relations internationales de l’Union et de ses États membres (voir, en ce sens, arrêt Kadi et Al Barakaat International Foundation/Conseil et Commission, précité, point 342).
If, as has been noted at paragraph 61 above, an exception to that fundamental right has been allowed with regard to initial decisions to freeze funds, that is justified by the need to ensure that the freezing measures are effective and, in short, by overriding considerations to do with safety or the conduct of the international relations of the Union and of its Member States (see, to this effect, Kadi and Al Barakaat International Foundation v Council and Commission, paragraph 342).

H. considérant que dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission , la Cour a annulé le règlement (CE) n° 881/2002, pour autant qu'il concernait M. Yassin Abdullah Kadi et Al Barakaat International Foundation, et a considéré que l'autorité communautaire qui décide de geler les fonds et les ressources économiques d'un individu ou d'une entité conformément au règlement (CE) n° 881/2002 doit l'informer des raisons sur lesquelles elle fonde sa décision afin de respecter les droits de la défense, en particulier le droit à être entendu et le droit à révision judiciaire, et que, compte tenu du fait que ces personnes ou entités n'étaient pas informées des charges accumulées contre elles, elles n'ont pas été en mesure de défendre leurs droits vis-à-vis de ces charges dans des conditions satisfaisantes devant la juridiction communautaire,
H. whereas in the above-mentioned Case Kadi and Al Barakaat International Foundation v Council and Commission , the Court of Justice annulled Regulation (EC) No 881/2002, in so far as it concerned Mr Yassin Abdullah Kadi and Al Barakaat International Foundation, and considered that the Community authority deciding to freeze the funds and economic resources of an individual or entity in accordance with Regulation (EC) No 881/2002 must communicate the grounds on which that decision is based to the individual or entity concerned, in order to observe the rights of defence, in particular the right to be heard and the right to judicial review, and that, given that those persons or entities were not informed of the evidence adduced against them, they had also been unable to defend their rights with regard to that evidence in satisfactory conditions before the Community judicature,

H. considérant que dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission, la Cour a annulé le règlement (CE) n° 881/2002, pour autant qu'il concernait M. Après avoir attentivement examiné les observations formulées par Al Barakaat International Foundation dans une lettre datée du 9 novembre 2008, la Commission estime, au vu du caractère préventif du gel des fonds et des ressources économiques, que l’inscription d’Al Barakaat International Foundation sur la liste se justifie en raison de ses rapports avec le réseau Al-Qaida.
After having carefully considered the comments received from Al Barakaat International Foundation in a letter dated 9 November 2008, and given the preventive nature of the freezing of funds and economic resources, the Commission considers the listing of Al Barakaat International Foundation is justified for reasons of its association with the Al-Qaida network.

Le 3 septembre 2008 , la Cour de justice a décidé d’annuler le règlement (CE) no 881/2002 en ce qui concerne Yassin Abdullah Kadi et Al Barakaat International Foundation.
