Individual and occupational pension products, recognised under national law as having the primary purpose of providing the investor with an income in retirement, should be excluded from the scope of this Regulation, in consideration of their peculiarities and objectives, whereas other individual insurance accumulation or saving products that offer investment opportunities should be covered by this Regulation.

(7 ter) Considérant les travaux actuellement entrepris par l'Autorité européenne des assurances et des pensions professionnelles sur les exigences en matière de communication des informations sur les produits de retraite individuels et compte tenu des particularités de ces produits, la Commission devrait évaluer, dans les quatre ans suivant l'entrée en vigueur du règlement, s'il convient de continuer à exclure les produits de retraite qui sont reconnus par le droit national comme ayant pour objectif principal de fournir à l'investisseur un revenu lorsqu'il sera à la retraite et qui lui donnent droit à certaines prestations.
(7b) Having regard to the ongoing work undertaken by the European Insurance and Occupational Pensions Authority on disclosure of product information requirements for personal pension products and taking into account the specificities of these products, the Commission, within four years after entry into force of the Regulation, should assess whether to maintain the exclusion of pension products which, under national law, are recognized as having the primary purpose of providing the investor with an income in retirement, and which entitle the investor to certain benefits.
