Notes the UN's apparent failure properly to apply the financing agreement signed between the Commission and it regarding the European Agency for Reconstruction, leaving the Court frequently unable to carry out adequate financial control of payments and underlying documents concerning contracts managed or overseen by the United Nations Mission in Kosovo (UNMIK); notes the statement by the Deputy Special Representative of the Secretary-General of the United Nations to grant full access to all files at the request of the Court; urges however the Commission to review the financing agreement with the UN; is of the opinion that a possible phasing out of the European Agency for Reconstruction should not be done according to a pre-set timetable but should depend on economic and political criteria and developments, making full use of the added value of the Agency in terms of expertise and know-how developed over the years, and asks the Commission to bring forward a proposal after a proper final evaluation to see whether the mandate of the reconstruction agency could be altered in such a way that that existing expertise and know-how could be used to provide reconstruction assistance wherever needed, for example in Iraq, Afghanistan, Pakistan, India and the countries affected by the Tsunami, as a second stage after immediate humanitarian needs have been addressed by the Humanitarian Aid Office;

À cet égard, le Conseil ECOFIN invite la Commission à étudier les différentes possibilités de fixer des objectifs quantifiables pour la réduction de la charge administrative résultant de la réglementation de l'UE dans des secteurs déterminés et à formuler de nouvelles propositions dans ce domaine pour le printemps 2006; engage la Commission et les États membres à poursuivre et à intensifier leur coopération en vue de réexaminer l'utilisation de la méthodologie et invite la Commission à faire rapport sur les avancées enregistrées et sur les enseignements qui auront pu en être retirés, après une phase initiale d'application de douze mois, afin de procéder, si cela s'avère nécessaire, à une adaptation de la méthodologie de telle sorte que l'on tire le meilleur parti possible de la mesure des charges administratives dans l'amélioration du cadre réglementaire au sein de l'UE; note que c'est sur les PME que les procédures administratives et les obligations réglementaires complexes pèsent le plus et se félicite de l'intention qu'a la Commission de s'attaquer à ces charges dans le cadre de son programme de simplification et de son activité en général, tout en respectant les principes de subsidiarité et de proportionnalité.
In this context, the Council (ECOFIN) invites the Commission to explore options for establishing measurable targets for the reduction of the administrative burden of EU regulation in specific sectors and to bring forward proposals on this issue by spring 2006; calls for continued and enhanced cooperation between the Commission and the Member States to review use of the methodology and invites the Commission to report on the progress made and lessons learned after an initial, twelve month, implementation phase, with a view to adapting, if necessary, the methodology, in order to maximise the contribution of administrative burden measurement to improving the regulatory environment in the EU; and notes that administrative procedures and complex regulatory requirements often impose the greatest burdens on SMEs and welcomes the intention of the Commission to address these burdens through its simplification and wider work programme while respecting the principles of subsidiarity and proportionality.
