(4) As soon as practicable after an offender whose address appears on the ticket, the certificate of service or other document in the court file is convicted under paragraph (3)(a), the clerk of the court shall cause a notice of the conviction to be sent to the offender by ordinary mail.

36. Dans les meilleurs délais suivant la déclaration de culpabilité rendue en l’absence du contrevenant, le greffier lui fait parvenir par courrier ordinaire, à son adresse inscrite au procès-verbal, à l’attestation de signification ou à tout autre document au dossier, l’avis de déclaration de culpabilité, les montants de l’amende et des frais et le délai accordé pour leur paiement.
36. As soon as practicable after an offender, whose address appears on the ticket, the certificate of service or other document in the court file, is convicted in the absence of the offender, the clerk of the court shall cause a notice of the conviction, the amounts of any fine and fees and any time allowed for their payment to be sent to the offender by ordinary mail.

(2) Evidence that a notice or document required or authorized to be given or delivered to a person under this Act was sent by ordinary mail to the person at his or her address appearing on a ticket, certificate of service or other document in the court file is evidence that the notice or document was given or delivered to the person.

(23a) Whereas the obligations laid down in the Directive should apply to a lawyer, tax consultant, notary or accountant only if he/she is involved to a significant extent in the activities of his/her client; whereas this means, for example, that the simple act of drawing up a draft contract of sale or draft articles of association would not trigger the obligations laid down in the Directive; whereas those obligations would be triggered only by the representation of his/her client by the lawyer, in which connection representation will cover not only acting as the client's agent, for example in connection with the conclusion of contracts, but any active participation, for example in negotiations;
