La Commission estime que l'obligation de déclaration préalable qui s'applique non seulement pour la mise à disposition de travailleurs mais aussi pour chaque emploi sur chaque chantier individuel rend plus difficile une prestation de services transfrontalière par rapport à une prestation de services interne.
Fourthly, the German law referred to above stipulates that foreign firms performing temporary work must make a declaration to the German Labour Inspectorate concerning all workers to be made available to a German client before any specific project begins. The Commission regards this obligation, which applies not only to the provision of workers, but to every job on every single site, makes the provision of cross-border services more difficult than the provision of internal services.
