Users acquiring Plant Genetic Resources for Food and Agriculture (PGRFA) in a country that is a Party to the Nagoya Protocol which has determined that PGRFA under its management and control and in the public domain, not contained in Annex I to the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA), will also be subject to the terms and conditions of the standard material transfer agreement for the purposes set out under the ITPGRFA, shall be considered to have exercised due diligence in accordance with paragraph 3 of this Article.

In the light of the fact that the nitrite/nitrate and sulphites questions are to be examined further in the Scientific Committee for Food and are subsequently to be the subject of further discussions, Denmark will for the time being refrain from voting against the proposal in the belief that when the negotiations have been concluded and the proposal is finally ready for adoption, sufficient progress will have been made for Denmark to be able to co-operate in its adoption. If the Directive has not acquired a satisfactory content in terms of health protection when it is discussed by the Council for the last time, Denmark will vote against the proposal.
