Le premier alinéa du présent paragraphe s’applique en particulier aux sanctions pécuniaires à appliquer à des établissements de crédit, à des compagnies financières holdings ou à des compagnies financières holdings mixtes pour des infractions au droit national transposant les directives pertinentes, et à toute sanction administrative ou mesure administrative à imposer à des membres du conseil d’administration d’un établissement de crédit, d’une compagnie financière holding ou d’une compagnie financière holding mixte ou à tout autre individu qui, en vertu du droit national, est responsable d’une infraction commise par un établissement de crédit, une compagnie financière holding ou une compagnie financière holding mixte.
The first subparagraph of this paragraph shall be applicable in particular to pecuniary penalties to be imposed on credit institutions, financial holding companies or mixed financial holding companies for breaches of national law transposing relevant Directives, and to any administrative penalties or measures to be imposed on members of the management board of a credit institution, financial holding company or mixed financial holding company or any other individuals who under national law are responsible for a breach by a credit institution, financial holding company or mixed financial holding company.

Where institutions authorised in two or more Member States have as their parent the same parent financial holding company, the same parent mixed financial holding company in a Member State, the same EU parent financial holding company or the same EU parent mixed financial holding company, supervision on a consolidated basis shall be exercised by the competent authorities of the institution authorised in the Member State in which the financial holding company or mixed financial holding company was set up.

4. Where more than one institution authorised in the Union has as its parent the same financial holding company or mixed financial holding company and none of those institutions has been authorised in the Member State in which the financial holding company or mixed financial holding company was set up, supervision on a consolidated basis shall be exercised by the competent authority that authorised the institution with the largest balance sheet total, which shall be considered, for the purposes of this Directive, as the institution controlled by an EU parent financial holding company or EU parent mixed financial holding company.
