On 28 April 2015, the European Central Bank (ECB) received a request from the European Commission for an opinion on a proposal for a Commission regulation amending Commission Regulation (EC) No 1708/2005 laying down detailed rules for the implementation of Council Regulation (EC) No 2494/95 as regards the common index reference period for the harmonised index of consumer prices, and amending Regulation (EC) No 2214/96 (1) (hereinafter the ‘proposed regulation’).

Toutefois, comme le reconnaît la Commission elle-même, le fait de modifier le régime des sanctions ne peut améliorer à lui seul les modalités d'élaboration et d'utilisation des indices de référence. En effet, les sanctions n'éliminent pas les risques de manipulation découlant d'une gestion inadéquate, en termes de gouvernance, du processus d'élaboration des indices de référence, dès lors qu'interviennent dans celui-ci des conflits d'intérêt et des appréciations discrétionnaires.
As the Commission has pointed out, however, changing the sanctioning regime alone will not improve the way in which benchmarks are produced and used; sanctioning does not remove the risks of manipulation arising from the inadequate governance of the benchmark process where conflicts of interest and discretion exist.

Il convient en particulier d'habiliter la Commission à accorder des dérogations à certaines parties du présent règlement lorsque la législation d'un pays tiers importateur le requiert, à fixer une quantité maximale de produits édulcorants utilisés pour compléter le goût, à accorder une dérogation aux règles régissant l'indication d'une durée de vieillissement ou d'un âge, à adopter des décisions sur les demandes d'enregistrement, sur l'annulation et sur le retrait d'indications géographiques, ainsi que sur la modification de la fiche technique, à modifier la liste des définitions et des exigences techniques, les définitions des boissons spiritueuses classées en catégories et la liste des indications géographiques enregistrées, et à déroger à la procédure régissant l'enregistrement des indications géographiques et la modification de la fiche technique.
In particular, the Commission should be empowered to: grant derogations from certain parts of this Regulation where the law of an importing country so requires; lay down a maximum level of sweetening for rounding off; grant a derogation from the rules governing the indication of a maturation period or age; adopt decisions on applications for registration, on cancellation and on removal of geographical indications, as well as on the alteration of the technical file; amend the list of technical definitions and requirements, the definitions of spirit drinks classified into categories, and the list of registered geographical indications; and to derogate from the procedure governing the registration of geographical indications and the alteration of the technical file.

1. Quand, à la suite de l'évaluation de données sur la pharmacovigilance vétérinaire, un État membre considère qu'il faut suspendre, retirer ou modifier l'autorisation de mise sur le marché pour réduire les indications ou la disponibilité, modifier la posologie, ajouter une contre-indication ou une nouvelle mesure préventive, il en informe immédiatement l'agence, les autres États membres et le titulaire de l'autorisation de mise sur le marché.

Where, as a result of the evaluation of veterinary pharmacovigilance data, a Member State considers that a marketing authorization should be suspended, withdrawn or varied to restrict the indications or availability, amend the posology, add a contraindication or add a new precautionary measure, it shall forthwith inform the Agency, the other Member States and the marketing authorization holder.
