For the purpose of ensuring that a posted worker receives the correct pay and provided that allowances specific to posting can be considered part of minimum rates of pay, such allowances should only be deducted from wages if national law, collective agreements and/or practice of the host Member State provide for this.

Aux fins de la présente décision, on entend par «END effectuant un détachement sans frais» un END pour lequel le SEAE ne verse aucune des indemnités visées aux chapitres III ou IV ou ne supporte aucun des frais visés dans la présente décision, sauf ceux qui sont liés à l'accomplissement des tâches confiées à l'END au cours de son détachement, et sans préjudice d'un accord différent entre le SEAE et l'administration qui détache l'END effectuant un détachement sans frais.

For the purposes of this Decision, a ‘cost-free SNE’ shall mean an SNE for whom the EEAS does not pay any of the allowances provided for in Chapters III or IV or cover any of the expenses provided for in this Decision, other than those related to the performance of their duties during their secondment, and without prejudice to any different agreement between the EEAS and the administration which seconds the cost-free SNE.

Except where the place of origin of an SNE is 150 km or less from the place of secondment, he shall, where appropriate, receive an additional flat-rate allowance equal to the difference between the gross annual salary (less family allowances) paid by his employer plus any allowances paid by the GSC, pursuant to Article 15, and the basic salary payable to an official in step 1 of grade AD 6 or grade AST 4, depending on the function group to which he is assimilated.

7. Pour l'END affecté à un bureau de liaison du SGC ou en tout autre lieu où l'Union agit dans le cadre d'une décision arrêtée par le Conseil, les indemnités visées aux paragraphes 1 et 2 peuvent être remplacées par une indemnité de logement, par décision motivée du directeur général du personnel et de l'administration, lorsque les circonstances liées au coût du logement au lieu de détachement le justifient.

For SNEs seconded to a GSC Liaison Office or to any other place where the Union operates under a decision adopted by the Council, the allowances referred to in paragraphs 1 and 2 may be replaced by a housing allowance where this is justified by circumstances relating to accommodation costs at the place of secondment, subject to a reasoned decision by the Director-General of Personnel and Administration.

4. Toutefois, l'END victime d'un accident lié à son travail survenu pendant la période de détachement continue de percevoir l'intégralité des indemnités prévues à l'article 15, paragraphes 1 et 2, pendant toute la durée de son inaptitude au travail et jusqu'à la fin de la période de détachement.
4. However, a SNE who is the victim of a work-related injury which occurs during the secondment shall continue to receive, in full, the allowances provided for in Article 15(1) and (2) throughout the period during which he is unfit for work up to the end of the period of secondment.
