IN-CONTEXT TRANSLATIONS

1. Le statut des fonctionnaires et le régime applicable aux autres agents ainsi que les réglementations adoptées d’un commun accord par les institutions de l’Union aux fins de l’application de ce statut et de ce régime s’appliquent au chef du Parquet européen et aux procureurs européens, aux procureurs européens délégués, au directeur administratif et au personnel du Parquet européen, sauf disposition contraire du présent règlement.
1. The Staff Regulations and the Conditions of Employment and the rules adopted by agreement between the institutions of the Union for giving effect to those Staff Regulations and Conditions of Employment shall apply to the European Chief Prosecutor and the European Prosecutors, the European Delegated Prosecutors, the Administrative Director and the staff of the EPPO, unless otherwise provided for in this Regulation.

3. Where the Director is prevented from exercising his or her functions or the post is vacant and no official has been designated by the Supervisor, the Director’s functions shall be exercised by the Head of Unit or Sector present with the highest grade or, in the event of equal grade, by the Head of Unit or Sector with the greatest seniority within the grade or, in the event of equal seniority, by the eldest.

F. whereas opposition leader and Mayor of Caracas, Antonio Ledezma, who was democratically elected on 23 November 2008, has been unable to take up his duties as mayor because the City Council premises in the Palacio de Gobierno have been illegally occupied by Bolivarian groups, with the Venezuelan Ministry of the Interior so far having made no effort to remove them; whereas President Chávez has recently enacted a law directly affecting the powers of the Mayor, under which a hierarchical superior chosen by the President of the Republic has been appointed Head of the Government of Caracas, with authority over the Mayor of Caracas, who will be stripped of practically all his powers, including the administration of public finance, the drawing-up and implementation of development plans and supervision of the institutions of the decentralised administration of the Capital District,

During the period of entitlement to the allowance, and for the first six months thereafter, the official referred to in Articles 41 and 50 of the Staff Regulations shall be entitled, in respect of himself and persons covered by his insurance, to benefits under the sickness insurance scheme provided for in Article 72 of the Staff Regulations, on condition that the official pays the appropriate contribution calculated by reference, as the case may be, either to his basic salary or to the percentage thereof specified in paragraph 1 of this Article and that he is not gainfully employed";

«1 bis.
