Conformément à l’arrêt du 27 novembre 2008, Intel Corporation (C-252/07, Rec. 2008 p. I-8823), la preuve que l’usage de la marque postérieure porte ou porterait préjudice au caractère distinctif de la marque antérieure suppose que soient démontrés une modification du comportement économique du consommateur moyen des produits ou des services pour lesquels la marque antérieure est enregistrée consécutive à l’usage de la marque postérieure ou un risque sérieux qu’une telle modification se produise dans le futur.
Following the Court of Justice's judgment in Case C-252/07 Intel Corporation (2008) ECR I-8823, proof that the use of the later mark is or would be detrimental to the distinctive character of the earlier mark requires evidence of a change in the economic behaviour of the average consumer of the goods or services for which the earlier mark was registered consequent on the use of the later mark, or a serious likelihood that such a change will occur in the future.

Moyens invoqués: la violation de l’article 15, paragraphe 1, sous a) du règlement no 207/2009, dans la mesure où l’usage que l’autre partie à la procédure fait de la marque entraîne une modification délibérée du concept original de marque que représente cette marque et, par conséquent, aboutit à une altération substantielle du caractère distinctif de la marque «MAESTRO», et la violation de l’article 8, paragraphe 1, sous b), du règlement no207/2009, dans la mesure où il n’existerait pas de risque de confusion entre les marques en conflit.
Pleas in law: Infringement of Article 15(1)(a) and related articles of Regulation No 207/2009, since the use made by the defendant of the opposing mark constitutes a deliberate change in the original concept of the mark represented by the opposing mark and, therefore, substantially alters the distinctive character of the mark ‘MAESTRO’, and infringement of Article 8(1)(b) of Regulation No 207/2009, since there is no likelihood of confusion between the conflicting marks.

(23) Pour des raisons d’équité et de sécurité juridique, l’usage d’une marque européenne sous une forme qui diffère par des éléments n'altérant pas le caractère distinctif de la marque dans la forme sous laquelle celle-ci a été enregistrée devrait suffire à préserver les droits conférés, que la marque ait ou non été enregistrée sous la forme sous laquelle il en est fait usage.
(23) For reasons of equity and legal certainty the use of a European trade mark in a form differing in elements which do not alter the distinctive character of the mark in the form in which it is registered should be sufficient to preserve the rights conferred regardless of whether the trade mark in the form as used is also registered.

Sur opposition du titulaire d'une marque antérieure au sens du paragraphe 2 ou d'une indication géographique communautaire antérieure, la marque demandée est également refusée à l'enregistrement si elle est identique ou similaire à la marque ou indication géographique antérieure et si elle est destinée à être enregistrée pour des produits ou des services qui ne sont pas similaires à ceux pour lesquels la marque ou indication géographique antérieure est enregistrée, lorsque, dans le cas d'une marque communautaire ou indication géographique communautaire antérieure, elle jouit d'une renommée dans la Communauté et, dans le cas d'une marque nationale antérieure, elle jouit d'une renommée dans l'État membre concerné et que l'usage sans juste motif de la marque demandée tirerait indûment profit du caractère distinctif ou de la renommée de la marque ou indication géographique antérieure ou qu'il leur porterait préjudice".
5. Furthermore, upon opposition by the proprietor of an earlier trade mark within the meaning of paragraph 2, or of an earlier Community or geographical indication, the trade mark applied for shall not be registered where it is identical with or similar to the earlier trade mark or geographical indication and is to be registered for goods or services which are not similar to those for which the earlier trade mark or geographical indication is registered, where, in the case of an earlier Community trade mark or geographical indication, the trade mark or geographical indication has a reputation in the Community and, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the trade mark applied for would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark or geographical indication ".
