This Regulation shall apply without prejudice to related Union legislation in the fields of inter alia safety of the food chain, animal health and welfare, plant health, and plant reproductive material, and in particular to Regulation (EU) No XX/XXX of the European Parliament and of the Council[36] (plant reproductive material) and Regulation (EU) No XX/XXXX of the European Parliament and of the Council[37] (protective measures against pests of plants).

Deze verordening is van toepassing onverminderd gerelateerde wetgeving van de Unie op het gebied van, onder meer, veiligheid van de voedselketen, gezondheid en welzijn van de dieren, gezondheid van planten, en vegetatief teeltmateriaal, met name onverminderd Verordening (EU) nr. XX/XXX van het Europees Parlement en de Raad[36] (vegetatief teeltmateriaal) en Verordening (EU) nr. XX/XXX van het Europees Parlement en de Raad[37] (beschermende maatregelen tegen plaagorganismen bij planten).

(21) In order to ensure quality, traceability and compliance with this Regulation and adaptation to technical developments, the power to adopt certain acts should be delegated to the Commission in respect of establishing rules amending or supplementing the specific plant production rules as regards cultivation practices, soil management and fertilisation, plant health and management of pests and weeds, management of mushroom production and other specific plants and plant production systems, the production origin of plant reproductive material and the collection of wild plants.
(21) Om kwaliteit, traceerbaarheid, naleving van deze verordening en aanpassing aan technische ontwikkelingen te garanderen, moet de Commissie ertoe worden gemachtigd handelingen vast te stellen met betrekking tot voorschriften tot wijziging of aanvulling van de specifieke voorschriften voor plantaardige productie, op het gebied van teeltpraktijken, beheer en bemesting van de bodem, gezondheid van planten, beheer van plaagorganismen en onkruid, beheer van de champignonteelt en andere specifieke planten en systemen voor plantaardige productie, de oorsprong van vegetatief teeltmateriaal en de vergaring van wilde planten.

On 6 May 2013, the Commission adopted a proposal for a Regulation of the European Parliament and of the Council on official control and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health, plant reproductive material, plant protection products .

This Regulation establishes the category of priority pests.

This Regulation is part of the ‘Smarter rules for safer food’ legislative package. The package contains four sectoral pieces of legislation on animal health, plant health, plant reproductive material and official controls, as well as a horizontal regulation bringing together the financial provisions: the expenditure management regulation.

2. For the purposes of paragraph 1, the official controls referred to in point (a) of that paragraph shall include official controls performed to verify compliance with measures adopted by the Commission in accordance with Article 137 of this Regulation, Article 53 of Regulation (EC) No 178/2002, Articles 27(1), 29(1), 40(2), 41(2), 47(1), 49(2) and 50(2) of Regulation (EU) No XXX/XXXX [Office of Publications, please insert number of the Regulation on protective measures against pests of plants], and Part VI of Regulation (EU) No XXX/XXXX [Office of Publications, please insert number of the Regulation on animal health], unless the decision establishing the measures requires otherwise.

In addition, Article 2(1)(i) of Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community , offers a legal basis for training in the plant health sector so that the training activities organised by the Commission constitute an overall Community training strategy in the areas of food law, feed law, animal health and animal welfare rules, as well as plant health rules (hereinafter referred to as the food safety training measures covered by Regulation (EC) No 882/2004 and Directive 2000/29/EC).

1. The Commission shall be assisted by the Standing Committee on the Food Chain and Animal Health instituted by Article 58 of Regulation (EC) No 178/2002 or, where dealing with matters mainly relating to plant health, by the Standing Committee on plant health set up by Council Decision 76/894/EEC .
