The Commission, in liaison with Member States, shall contribute to the implementation of Union commitments towards increased transparency and accountability in the delivery of assistance, including by publicly disclosing information on assistance volume and allocation, ensuring that data is internationally comparable and can be easily accessed, shared and published.

‘Social assistance’ refers to assistance granted by the public authorities, whether at national, regional or local level, which can be claimed by an individual, in this case the sponsor, who does not have stable and regular resources sufficient to maintain him/herself and the members of his/her family and who, by reason of that fact, is likely to become a burden on the social assistance system of the host MS during his/her period of residence[41].

According to established case-law (18), where the public body granting financial assistance enjoys a degree of latitude which enables it to choose the beneficiaries or the conditions under which the financial assistance is provided, that assistance cannot be considered to be general in nature.

Recalls that Directive 2004/38 circumscribes the possibility of expelling a Union citizen within very clearly defined limits, notably the fact of being a threat to public order or public security or of being an unreasonable burden on the social assistance system; expulsions decisions have to be assessed and decided individually, taking into consideration the personal circumstances (Article 28), procedural safeguards have to be applied (Article 30), access to judicial and administrative suspension and redress procedures shall be guaranteed (Article 31), expulsions of citizens on grounds of representing an unreasonable burden on the host Member State's social assistance system is not sufficient in itself to justify automatic expulsion (recital 16 and Article 14), any restriction of freedom of movement and residence based on grounds of public policy, public security or public health cannot be invoked to serve economic ends, shall be proportional and be based solely on the personal conduct of the individual concerned and not on considerations of general prevention and the personal conduct of the individual concerned must represent a genuine, present and sufficiently serious threat affecting one of the fundamental interests of society (Article 27), sanctions laid down by Member States must be effective and proportionate (Article 36) and persons have to be given at least one month to leave;

Emphasises the lack of clarity in the area of socially responsible public procurement, and calls on the Commission to provide assistance in the form of manuals; draws attention, in this connection, to the changes in the legal framework brought about by the Lisbon Treaty and the Charter of Fundamental Rights, and looks to the Commission to implement the relevant provisions in an appropriate manner; emphasises the underlying problem that social criteria relate to the manufacturing process, so that their impact is generally indiscernible in the final product, and that globalised production systems and complex supply chains make compliance with the criteria difficult to monitor; expects, therefore, precise, verifiable criteria and a database containing product-specific criteria to be developed for the area of socially responsible public procurement as well; draws attention to the problems faced by contracting authorities, and the costs they incur, in verifying compliance with such criteria, and calls on the Commission to offer suitable assistance and to promote instruments which can be used to certify the reliability of supply chains;

All candidate and potential candidate countries receive substantial community assistance provided notably through the 'Technical Assistance and Institution Building' component of the Instrument for Pre-Accession Assistance (IPA) but also through the TAIEX programme, which assist in adoption, application and enforcement of the Community acquis (including in the areas of conformity assessment, public procurement, IPR, etc.).

The Federal Government has taken the initiative of allowing the "centres publics d'aide sociale" (social assistance centres) to step up their efforts in terms both of prevention and cure, by adopting an Act of 4 September 2002 assigning to the social assistance centres the task of providing guidance and financial social assistance in the context of the supply of energy to the very poor.
